My ex has not paid a penny towards our dc since we split up seven years ago, he has been on a low income which is fair enough while I earned a wage.

During that time however he has had two huge tax rebates of more that a thousand pounds and offered nothing, I have asked him during these times for help with uniform for our dc but got nothing because "he needed it".

He has now just been given seven thousand pounds he was owed and is still insistant he needs it all.

Go to the CSA and ask them to assess his income.

olympicblues · 19/08/2012 19:44

can they do that off a one off payment Ladysybil?
I would not ask for it if we were not struggling tbh.

Why isn't he paying?

I don't agree with the pay-for-view thing that some subscribe to, but is he a part of the childrens lives?

If you aren't demanding/making/ensuring that he is contributing financially to their lives on a regular basis, I can't see how you can reconcile that with one off requests.

olympicblues · 19/08/2012 19:50

He has not been paying because he was on a low income and appealed against the £5 min a week saying he could not afford it.

Yes he is part of the children's lifes, not fully as he comes when he feels like it but he does come occassionally

Well, it's income and it needs to be declared as such. I'm self employed but get paid in one lump sum at first, it's all declared. He needs to declare it to the tax office as well.

JumpingThroughMoreHoops · 19/08/2012 19:55

If his income is that low, then a £1,000 to him probably covered a hell of a lot of bills, got him out of shit debt.

That doesnt absolve his responsibility to his children of course.

JumpingThroughMoreHoops · 19/08/2012 19:57

lady is a tax rebate income? Surely what you earn is income. The fact HMRC cocked up does not make a rebate a second income stream?

Wigglewoo · 19/08/2012 19:59

Even on a low income surely he should pay something??? Plenty of single mums on low incomes still manage to pay for their children... (Scratches head).

I'd contact csa or a solicitor and go from there.

LadySybildeChocolate · 19/08/2012 20:10

All of it? Shock

olympicblues · 19/08/2012 20:14

He spent hundreds on designer clothes, the latest payment was a payout was income based and seven thousand pounds.

Lol at needing to declare his tax rebate to the tax office!

LadySybildeChocolate · 19/08/2012 20:52

Sorry, the OP didn't say all of it was a rebate, just that he's been given thousands that he owes.

CouthyMow · 19/08/2012 20:55

Just because he appeals against the £5 minimum, doesn't mean that YOU can 't put an appeal in saying that the CSA are 'depriving your DC's of income' by refusing to take the minimum payment from him. Using the phrase 'The CSA are depriving my children of income that they are entitled to have to go towards supporting them' puts a rocket up the CSA's arse...Wink
