To just go round to their house and ask/demand a refund?

I bought a baby swing off netmums. They live just round corner from me. It doesn't work. It has been stored with batteries in and one has leaked.

I know I should have checked before I bought it, but they had no batteries and I am naively trusting. I have emailed explaining, but no reply. Should I just go round and ask for refund? Do I have any legal rights if they refuse.

I have a 2 week old, I am sleep deprived and have cried a lot at my stupidity this afternoon.

No, Yorkshire. But thanks.

I did actually ask if it works and they said yes. But presumably they didn't check it? I am trying to be positive and trusting and assume they just didn't check it.

Dh has cleaned it out, but it still wasn't working.

Ignore DH (but you knew I was going to say that!)

Give them chance to read email and then if nothing pop over tomorrow. You've just had DD and are all caught up in that so be kind to yourself xx

rainbowinthesky · 17/08/2012 19:11

Very few people wouldn't refund you unless it was very cheap and therefore no real surprise it wouldn't work.

muddyjumpers · 17/08/2012 19:22

I would pop round and tell them that when you put batteries in, it didn't work.

If no joy, you could clean the contacts to the batteries with a bit of sandpaper. I have got a few things working again in the past.

Just be kind to yourself. It's only a chair at the end of the day.

Un mn ((((hugs))))

FartyMcTarty · 17/08/2012 19:24

Can you try contacting via NM if they don't reply, in the hope that they'd be ashamed not to refund you?

CanoeSlalom · 17/08/2012 20:09

YABU I'm afraid. It was up to you to check it when you saw it.

MrsKeithRichards · 17/08/2012 20:15

I got one second hand for free and I've never put batteries in it so don't know id it works or not but is perfectly fine, I just swing it by hand every now and then!

Socknickingpixie · 17/08/2012 20:25

thats a really good point mrsKeith, some of mine have prefered it when swung like that instead of constantly.

KindnessofStrangers · 17/08/2012 20:27

I'm not sure where you live but if you don't manage to get a refund and are any where need London I have a vibrating baby chair you can have - it's a Fisher Price Newborn To Toddler Rocker. My DS has grown out of it but he loved it when he was tiny and saw him to about 7 months. PM if you would like it and are nearby.

Sleep deprivation makes the world seem so much worse!

MrsKeithRichards · 17/08/2012 20:31

Ps am in Edinburgh and said swing is just taking up room now if you want it!

KindnessofStrangers · 17/08/2012 20:31

Near not need, also not sure where all my commas have gone!

mayorquimby · 17/08/2012 20:39

Buyer beware or second hand doesn't relieve them of contractual obligations. If they said they were selling you a working item then that's a term of the contract that it was working.
I'd demand a refund off them

raininginbaltimore · 17/08/2012 21:50

Thanks for advice on contacts- I cleaned them down again and.....it works! hurrah!

Thank you for being kind in my over-tired, random, crying over a chair moment. And for the lovely people offering me theirs!
