Today I was driving, doing around 55 mph (national speed limit) when a car suddenly pulled out of a side road, literally practically in front of me. I had to slam the brakes on, the car skidded and slammed into the kerb, bounced off again and then slammed a second time.

I was screaming, it was absolutely terrifying and I had 1 year old DD with me too.

In fairness I will say the other car pulled over, apologised (and asked for directions Hmm) I just confirmed I was all right, though very shaken. They drove away.

It then emerged that considerable damage had been done to my vehicle when I slammed into the kerb presumably and I had to get the AA to pick us up (in the pouring rain) and go to a garage. Repair costs are likely to be around £500 but is the other driver at all liable?

I don't know much about it so please don't tear into me, I'm still very weepy and upset and we really, really can't afford £500 :(

Did you swap details with the other driver?

If you had right of way and the other driver pulled out in front of you then they are at fault.

Did you get their reg number?

I got her car registration details (two quite elderly ladies Grin) but nothing else. I should have, I realise, but my legs were shaking so much and my teeth were chattering ... God I keep reliving it!

I don't know but I would ring your insurance company right now this minute and see what they say. Not sure whta they can do to get money from other driver (think it was their fault from what you say) if you don't have other drivers' details but they will probably cover the cost

I am sorry to say I think this means a hike in your premium next year Brew

RawShark, we've only got 3rd party insurance on that car. We have 2 cars as they're needed for work but while my DH has to drive around, I don't, so my car is just an ancient Fiesta. Or rather was :(

Any witnesses? I'd make a report to the police and inform your insurance company.

Report it to your insurance company, they can trace her from the details.

But you've got the other drivers details, and it sounds like they were at fault. SO I would ring your insurance company ASAP to report and they will sort it out

in my book that constitutes a road accident, you should all have xchanged details and got witnesses, and if the impact with the kerb was that bad you ought probably to have got you and DD checked over at the hospital, seriously.

you could try reporting it/there may be CCTV?

but you shoudl also be able to claim on your own insurance as MIL did when someone hit her car and did not stop

RawShark, sorry, I meant it was national speed limit but I was doing 55, I was just explaining that I wasn't speeding Grin

Doin - no witnesses, I hope they won't contest it as they did in fairness come over to apologise. I just sort of brushed them off a bit as while I knew they had obviously not meant to do it, I was so shocked, frightened and angry as well to be honest. DD was howling and I felt sick with fear!

sorry sorry sorry am idiot re third party insurance. But they willl probably help you claim fromothe rparty'sinsurance?

The fact that they apologised means that they have admitted fault tbh.

If she said sorry and apologised then she admitted fault and is liable. Report it to your insurance company.

U can ring your insurance company and make a claim as long as you have their reg, get them to do a MID search on their reg. the sooner u do this and tell them, starting the claim, the better.

You really should get your little one checked over, she will probably have a headache, I suggest some paracetamol for her tonight. I would also take her to an osteopath, they are fantastic for whiplash.
