Df is a builder, and has been for 42 years. Couple in question are having their garage converted. Df has spent a fortnight on the job, it has passed building regs, but customers are now saying a window is wonky so they won't pay him. In actual fact the existing brickwork is pissed, window is straight.

Df is mortified, in 42 years he's never had a complaint or been knocked. Do you think shame would make them cough up or should he just accept that he's worked for 2 weeks for feck all? ( and paid for the materials) grrrrr

Can he take them to court?

faeriefruitcake · 01/08/2012 22:24

Small claims court and mediation, and write c*nt in bleach on their lawn

PicklesThePottyMouthedParrot · 01/08/2012 22:25

Small claims? Can he take his window back if not? See how they like them onions.

LadySybildeChocolate · 01/08/2012 22:26

faerie has it right, small claims court.

larks35 · 01/08/2012 22:31

Small claims definitely. Don't do the sign as tempting as it might be, it will go against him as they could legitimately claim against him.

DP works in the same trade and he always requires 3rd of quote up front and depending on the job a 3rd midway, with the final payment on completion. Does your Dad do the whole thing with no payment at all? Seems a little too trusting.

tittytittyhanghang · 01/08/2012 22:32

my uncle is a builder and similar happened to him. He's not the sort who would bother with small claims court so went to jobsite and took back all the materials right down to the bricks and mortar and made/left a huge mess in the process. Didn't get his money back but he tells me it was worth it.

larks35 · 01/08/2012 22:33

He could also legitimately reclaim any materials he has used that they haven't paid for if he doesn't want to go through the small claims route.

VivaLeBeaver · 01/08/2012 22:34

Going back and knocking the window out would be tempting.

larks35 · 01/08/2012 22:35

xposts titty, sounds satisfying to me. If your DF can afford to take the loss then that would be the route to take.

geegee888 · 01/08/2012 22:36

Small claims aren't actually that much hassle and you can do it all online. This is the sort of thing they are for. If they haven't paid, then the court will treat them quite harshly because in law they are meant to pay and then sue for anything not up to scratch. Your father might want to get references and an independent view on his work to strengthen his case.

eurochick · 01/08/2012 22:37

Yep, small claims court.

Bossybritches22 · 01/08/2012 22:41

Yep another for SCC here to, inlcude the costs of going to court & any legal advice costs too,in the claim. Oh & a sum to cover loss of earnings for the time spemt preparing the case & going to court.

Floggingmolly · 01/08/2012 23:42

They can't just refuse to pay. Sue them.

TheQueenOfDiamonds · 02/08/2012 00:55

Faeriefruitcake Can I steal that idea? OHs slimy bastard of an ex boss still owes us a couple of grand notice period pay and the courts were less use than a chocolate fireguard.
