one of my male friends is in a women's weekly magazine after his ex wife has sent in her story! It includes pictures of him with her and the children and names him too.

he works in education so it could be disastrous for him! Can the magazine just do this?

If a critical story has been printed without offering him a right of reply beforehand then this is a BIG problem for the magazine! But when you say he hasn't "given permission", do you mean they've contacted him beforehand and he's told them to f off? In which case they have given him a right of reply. It's not a case of him "giving permission" for it to run, if that was the case no critical articles would ever appear in print! You'd kill off the real life mag market right there.

And have you seen the actual article? If they print anything potentially libellous they will need to have collected evidence beforehand to back it up. If they haven't done this he's got them bang to rights. But in today's climate I imagine they will have.

Socking - what you say is not correct. If a person has been libelled then the burden of proof lies with the publication. The libelled person does not have to prove that it is not true, the publication must prove that it is.

nancy most of the things were very much not provable either way,hence why i was advised to keep my complaints compleatly to what i could disprove.

we all know the law allows for certain actions but there may be no point in taking those actions without much chance of sucess if the publications evidence is the tapes of the interviewe and a interview with a friend of hers both on the serface very reputable people and mine is just my word then its possibly not worth the risk.

i was petrifyed that if i was unsucessfull it would add weight to the story i expect thats why i was given that advice especially since the 'good faith' comment in the letter i got from the pcc knocked me for 6
