To think this is not fit for purpose and want a refund?

A pushchair (brand and store withheld etc). The brake pedals stick out further than the back wheels so you can't roll it up and down steps. The pedals catch on the step and scrape up the risers, damaging the pedals and putting the brake on. There's nothing wrong with it, just a poor design. I called the manufacturer and the store and the response was the same - basically, that's just the way it is and you're not supposed to pull it up and down stairs.
Well . . . sorry but how else am I going to move it? I'm in an apartment block with 3 steps at the front door. The shop suggested that I should fold it up and only unfold it when I'm on the flat. Now that's just physically impossible, I can carry the pushchair and my 4 month old to the door and down the steps okay, but how the chuffing hell do I unclip its catches (one each side) and pull it upright while holding the baby? And then what do I do when I come across a couple of steps when I'm out and about? I know this isn't a problem with all pushchairs as I used to have a different brand, so I was really surprised that such a well-known and long established company hadn't thought it would be a problem. But it seems I am stuck with it. Advice, folks?

The store staff were really helpful when I bought it, I just really didn't think to check for this particular problem. I will try the head office approach ('twas a well known high street retailer). Even so, I just think it's really crap for a major manufacturer (no not Mamas and Papas) to design something so incompatible with the reality of its use. It's just, oh I don't know, stupid and annoying. And expensive.

Give the retailer's head office a call and also contact the manufacturer. Hopefully, a goodwill gesture will be the outcome.

Google. The One Show. Sale of Goods Act. and see if that info helps. It may not be fit for purpose?????

If you're in line for buying a new buggy, can I just recommend a Maclaren. Our XT has been used pretty much every day for 8 years, thrown in and out of cars, has travelled the world and is still in great shape.

From the Sale of Goods Act:
The law says that any item you buy from a trader must be:
of satisfactory quality
fit for purpose
match any description given.

If it isn?t, you can usually get one of the following:
a repair
a replacement
your money back (a refund)
some of your money back.

You will not have these rights if:
there is nothing wrong with the goods ? you have just changed your mind about wanting them
you examined the goods, or a sample of the goods, when you were buying them, and the fault you want to complain about was so obvious that you should have noticed it
the trader pointed out the defect that you now want to complain about
you have damaged the goods yourself
the problem is the result of normal wear and tear
the goods have lasted for as long as could reasonably be expected.

From which I would suggest frame your complaint to reflect the fact that the buggy is not fit for the purpose for which it's intended - namely, to transport babies/infants on and off public transport, crossing roads which more often than not have kerbs, entering shops and other premises which may not have the facility of a ramp.

And that the fault you want to complain about was not obvious when you wheeled the buggy in the confines of the shop floor prior to purchase, and that had this particular model's limitations been pointed out to you by presumably trained/experienced shop staff you wouldn't have bought it.

What is the store's refund policy as stated on the back of your receipt?
