you should go to prison.

My bet is the woman is the child's mother. In which case even more so should she go to prison.

Clearly the woman is deeply unwell - but you're right - she should get the helps she needs away from people around her to whom she probably poses a danger still

astreetcarnamedknackered · 29/05/2012 20:17

I agree she should get help. But surely if not prison then custody in the form of a hospital order? Something to mark what she has done.

to me if they think someone is a harm to themselves or other around then the person should be sectioned under the mental heath act.

When I read headlines such as that I hope that the judge has made the right decision based on a lot more information than we have to hand, such as the pre-sentence report etc. It is hard to believe that such circumstances exist though unfortunately in this case.

I do not envy those sentencing in cases where the balance of rehabilitation, punishment and protection seem so at odds.

lovebunny · 29/05/2012 21:46

oh no. i can't help it. 'that's a shit thing to do'. sorry.

prison. unless the mental health 'sentence' is indefinite.

AnyoneforTurps · 29/05/2012 21:50

You can only section someone under the mental health act for treatment; it does not apply in a case like this.

Birdsgottafly · 29/05/2012 21:52

She has been placed under a Community Treatment Order, which, personally knowing the conditions of these and other similar cases, thisis the best course of action. A custodialsentence in this case wouldn't serve any purpose.

Ismeyes · 29/05/2012 22:02

Just to agree with Turps and Birdsgottafly, Mental Health Act would not be appropriate here, the CTO is the right thing to do and is obviously based on a lot more information than we have here.

Birdsgottafly · 29/05/2012 22:10

Just to add that she has been given a suspended sentence and on breaking the CTO, would be arrested and imprisoned.
