Job application form says the following:

Convictions
Employer is exempt from the 1974 Rehabilitation of Offenders Act (Exclusions & Exemptions) (Scotland) Order 2003.

This means that unless stated in the Job Description or Person Specification, you must tell us about any previous convictions either classed as 'spent' or 'unspent'.

If you are offered employment, any failure to disclose such convictions could result in dismissal or disciplinary action. Any information you provide will be considered only in relation to the post for which you are applying.

I think DH should put in his 'spent' speeding points. DH doesn't think he should. It is for a driver's job.

MN jury opinions gratefully received.

Yes he has to.

If it is for a driving job, they can check with the DVLA anyway so he would be a fool not to declare them.

We check paper licence and photocard licence once a year and ask for an insurance form to be filled in a put on file which then again asks for any convictions.

If he lies it will effect the company insurance and lead result in dismissal.

It isn't a big deal to have spent points but it is a very big deal not to admit to them.

he should, if he doesn't they will find out and he will DEFINITELY not get the job or be dismissed because it will be taken as dishonesty.

I don't believe that penalty points are a conviction for the purposes of disclosure. I can check with our disclosure unit tomorrow if you like ?

Just reread your OP and missed that it's for a driving job. Yes, he should definitely declare them.

No harm to put them in, best safe than sorry.

I always put in my spent points from 20 years ago in such cases, at the end of the day no-one cares about them. It's not like i've done anything terrible.

For what it's worth though, my speeding conviction and failure to produce documents within 7 days from 20 years ago have never actually come up on an enhanced CRB check (I have seen two of them).

Perhaps he cold ring the HR or recruitment dept and just ask the question, in a generic kind of anonymous way?

Call NACRO Resettlement Plus Helpline on 020 7840 6464 they'll be able to tell you. They deal with crim and civil convictions and will be up to date on the guidelines.
