To not want to return an item

Had some silver fingerprint jewellery made at Christmas. Stupid woman making it mis-read the order form and spelt name wrongly. Contacted her to arrange for it to be re-made, which she did. Then got phone call asking me to return the original item. I responded that I had really hoped to keep it given that it is my sons fingerprint (I suspect she wants to use it as a sample in her displays which I wouldn't be happy with - not sure why!) but her view is that it is faulty and should be returned since she was 'happy to re-make the piece'! - AIBU? No offer has been made for a partial refund etc for the inconvenience etc.

If she's made you a new one then I don't think you have any right to keep the other one tbh. She should pay the postage though.

Catsmamma · 27/01/2012 21:40

what's the point in keeping it?

you have your exchange, i cannot see the problem.

ScoutJemAndBoo · 27/01/2012 21:42

She probs wants to melt the silver down and reuse, it is her property.

ABigGirlDoneItAndRanAway · 27/01/2012 21:42

I think YABU, she has made you another one so you really should return the misspelled one, she probably wants to melt it down and reuse it but if she uses it in a display does it really matter? She should be collecting the faulty one though.

MsVestibule · 27/01/2012 21:43

Of course you should return it! At her expense of course, but if she's replaced the item, there's no reason why you should also keep the original faulty one.

larks35 · 27/01/2012 21:43

So you were sent an item that was incorrectly engraved, have been sent a replacement but want to keep the original too? If I've got that right then of course YABU. She probably wants to melt down the silver to use again. Or maybe she will use it as a sample but really that is not your concern. I'm amazed you are asking this really, would you expect high street shops to let you keep both a faulty and a replacement item?

JustHecate · 27/01/2012 21:44

She made a mistake, she has rectified that mistake, is giving you a replacement and you want to keep both? That's unreasonable of you.

Fankle75 · 27/01/2012 21:49

Fair do's. I'm just annoyed at the whole situation - tone of her email suggests I should be grateful that she put right what she has admitted was entirely her mistake, plus she seems to be expecting me to pay the postage to return said items.

yabu , she can melt it back down - it's not yours as she has replaced it. You could pay for a second one if you want to keep it.

she should pay postage costs though

IUseTooMuchKitchenRoll · 27/01/2012 22:05

You definatly have no right to keep the old one, but she should be paying the postage.

Tell her you will send it back as soon as you receive the pre paid envelope.

hippoCritt · 27/01/2012 22:10

Which company was it?

Fankle75 · 27/01/2012 22:14

I won't say on here Hippo - I'm not THAT annoyed! Wink

Never thought to ask her for a pre-paid envelope IUTMKR, thanks for the suggestion!

I do personalised jewellry but using photos. I can think of two reasons she'd want a return.

  1. To reuse the material
  2. To ensure you haven't ripped her off, believe me it happens. She needs to check the piece you've kept has a mistake on, and you weren't after two for one

As for the fingerprint, please don't worry, she could technically make a tonne of them, but I should imagine she does the same as we do. Any samples are with the written consent of the owner. All images are destroyed after 14 /28 days unless otherwise specified.

HTH Smile

Fankle75 · 27/01/2012 22:53

It was made using art clay - I'm not sure if it can be re-used. For same reason, she can't make any more - each piece has to be a physical print of the childs fingerprint. She knows I'm not ripping her off, she's seen the mis-spelt items. And she's not asked for consent re using them as a sample. Prepared to accept IABU re keeping it, shall return but ask for them not to be used as samples.

In that case I'm out of ideas Grin

Sorry! Grin

Art clay melts down into pure silver, which she can use again. She should definitely pay your return postage costs as it's her mistake, but YABU to expect to keep the item.

Pandemoniaa · 27/01/2012 23:12

I think YABU to expect it all, here. The "stupid" woman (you do sound like a less than charming customer, here, I'm afraid!) has put the mistake right so you are not out of pocket.

She should, of course, pay any postage incurred by returning the incorrect items but why should she need your permission to use the rejected items as a sample?

Fankle75 · 27/01/2012 23:32

Only venting on here - been very pleasant in RL, honest!

Just feel funny about my childs fingerprint being used in this way - unreasonable probably and I don't know why, but that's how I feel!

CointreauVersial · 27/01/2012 23:37

Don't be daft.

DorcasBouvier · 27/01/2012 23:38

Silver is really expensive at the moment, so I'm sure it would be more cost effective for her to use it in another project. You could always check with her and see what she intends to do with it. My bet is she'll re-use it for something else ~ that's what I would do :)

squeakytoy · 27/01/2012 23:41

It will be melted down, the fingerprint will cease to exist. YABU

TheParanoidAndroid · 28/01/2012 00:16

you know your pfb kids fingerprints are all over the fucking place...or will be soon anyway?
