Fricking lying cheating scum

Argh! Over the past year I have had two car accidents - both times, massively inconveniently, my car has been written off. Neither time was my fault, nor could it possibly have been - 1st time a car barged its way down a road with only space for one - cars parked on their side and I was already driving along. Second time (recently) I saw the car coming towards me, and was stationary (no space to pull in at all) waiting for it to crash into me head on.

Last time I was confused that they disputed liability.

This time I am fucking livid. My car was stopped! I had two small children in the car, my car was written off, I was (not badly) injured, and she IS DISPUTING LIABILITY?! Why do they all lie? I was even in the room when she told her insurance company my car was stationary. ARRRGGGGGGGGGGGHHHHHHHHHHH!

Sorry, rant over.

AIBU to think that people should think less about their insurance premiums and more about telling the fucking truth?

If you heard her tell the insurance company the truth, then it is probably the insurance company that are disputing it and forcing her to go along with it. I have heard of this happening before.

I have no idea why they would do that though. If its that clear cut, which it sounds like it is, you would think it would cost the insurance company more to fight it and then have to pay out anyway.

I hope you are ok, it sounds like you have had an awful time.

Angry What a b*t(h! Karma will bite her lying arse. Were there any witnesses? CCTV? Wink

LoopyLoopsHootyHoots · 16/01/2012 20:48

Thank you, you are very kind after I wrote that horrible sweary rant! It did feel better thougdh!

Do you think the insurance company would do that? I hope so, she seemed so nice (and apologetic) afterwards. Confused

No witnesses. Middle of nowhere. Properly.

Did you get the Police involved? They can tell how far a car is travelling from the damage done to it.

Bogeyface · 16/01/2012 20:51

I was a witness at an accident where there were several witnesses that said that no way was the "victim" at fault, but the insurance company still disupted it and in the end we were called to give evidence in court. The fault drivers insurance company eventually caved the day before the court date. I also worked in insurance years ago and it was standard practice then to dispute liability unless the driver was drunk or on drugs.

Westcountrywife · 16/01/2012 20:53

If it makes you feel better I had an accident under very similar circumstances a few years ago. He disputed it and we ended up in court. The judges final comments were that in his opinion I had absolutely no way of getting out of the way and the accident was the other drivers fault 100 per cent. Even at that stage he denied liability and lied to the end. I then found out I was the fourth car that year he had crashed into...!

Stay clear with your facts and don't get dragged into their lies. It really upset me that someone could lie about me like that to my face, but I had the final victory. Standing up and winning is your best revenge...

BillyBollyBandy · 16/01/2012 20:53

I got shouted at by my insurers for admitting liability and was told to NEVER admit anything.

I had accelerated into the back of a stationary car. Granted it was at a roundabout and there was enough room for a truck... but really how could I have disputed anything!

Agree it may be the insurers

MrsTerryPratchett · 16/01/2012 20:58

This happened to me years ago and I am still livid. She ran a red light with two kids in the car and totalled my little car. She got out and swore up and down that there was no light for her turn. I took her and showed her the light. She then said, "it must have been green". Her kids heard her lying though and I have always believed that lying in front of her children for monetary gain would come back and haunt her. I wanted my day in Court but the insurance companies wanted to do their thing. Bastards. Or "lying, cheating scum" as you so eloquently put it.

I hope she is a MNer. Yes, you, in the Alfa.

5inthebed · 16/01/2012 21:00

Oh I feel for you. I was involved in a crash in 2010, the driver of the other car admitted liability to the police at the scene, yet nearly 2 years on the claim is still on going as she disputed it with her insurance company, claiming I was confused at the roundabout Angry. Police only noted down they attended scene and not that she admitted it.

I hope that it does not drag on as long as mine has and that it goes in your favour.

NoOnesGoingToEatYourEyes · 16/01/2012 21:00

It may not be her, some insurance companies automatically send out a letter blaming the other party regardless of what their client has told them.

That happened to my DH, he was driving straight ahead on a dual carriageway and this man wanted to turn right from the opposite side of the road. He stopped but then turned out into DH's path and DH hit the side of his car.

DH had witnesses, the man admitted it to police officers at the scene and his insurance company (I can remember the name began with Z) sent a letter to DH the same day blaming him.

They wrote again a few days later to say he had admitted liability, so perhaps her company are just trying it on.

But people do lie. My Dad was parked in a car park when someone reversed into his car but the man lied and tried to say they were both moving at the time. Luckily my dad was able to get the CCTV to prove he hand't been moving at all.

I hope things work out for you OP, and this woman tells the truth in the end.

DeWe · 16/01/2012 21:30

When I was in a supermarket carpark some years ago, I saw two cars parked in opposite spaces reverse out at the same time and hit back to back almost exactly in the middle of the lane.

Both drivers jumped out and said in unison "why don't you look before you reverse?"

They got even angrier when everyone within hearing fell about laughing and the police had to be called Grin

Bogeyface · 16/01/2012 21:37

:o My late MIL did this deWe but with the lady who lived in the house opposite. They were both concentrating so hard on the road either side that neither of them looked behind them! I dont know what happened with insurance but knowing FIL he would insist on avoiding claiming and them both just paying out for their own damage.

clam · 16/01/2012 21:50

Friend of mine had someone skid downhill into the back of her in snow. That driver disputed it. Said she'd skidded backwards, uphill, into him!!

Think it might have been settled knock-for-knock! Often insurers can't be arsed to argue so let it go. Despite it possibly affecting your no-claims bonus.

Bogeyface · 16/01/2012 21:54

Clam, that reminds me of a shunt my sister had. An elderly lady went into the back of them at the lights and said that my sister had reversed into her! I dont know if that was disputed although I suspect not!
