to try and claim back for PIP implants on my credit card?

I had PIP implants 3 years ago. I believe I was mis-sold the implants, on the basis that I was told by my surgeon and the company I had the surgery with that they were 'top quality' and 'top of the range' implants and would last a lifetime, were extremely unlikely to ever rupture etc. I certainly didn't get cheap surgery. However, I know now there were concerns regarding these implants well before my surgery (which research at the time didn't reveal, but it was well known amongst surgeons etc) and that at the very least, these implants were much cheaper than other brands on the market at the time, so certainly weren't top quality.

Could I claim this back on my credit card? Am I right in thinking the credit card company would then pursue the surgery company for that money?

I think CC company will talk to you only after they satisfy themselves that you have approached the clinic in question first.

I think you should consider a consumer lawyer (that is already dealing with similar cases) for a initial 30min consult that should be free or join Which?Legal service at 9GBP/mo to get a good advice regarding wording the letter to your CC company.

With all the relevant data/research coming out I think you have a great case.

I gues you could try, I mean the worst case scenario is that the CC company says no, but I honestly wouldn't know as I've never had a credit card in my life.

Can't hurt to ask the CC company though.

Did the surgeon know about the problems?

I think you might have a case for the cost of the implants themselves but not the surgery / medical care.

What is the basis for your claim?

If you are thinking about the headlines made when airlines go bankrupt, you can apply for a refund to your credit card because the service paid for had not been rendered.

Some enhanced credit cards have insurance against breakage, but there are time limitations, eg 3 months. 'Services' are not included.

Caveat Emptor.

I do vaguely recall some coursework from the LPC about making a claim against a credit card company for a sofa purchased abroad that was never delivered, or something along those lines. That was in 2007. So that's the legal principle you're thinking of. If the credit card company are liable, they're liable regardless of whether you've approached the person/company who sold you the goods first. That's not to say they are liable though.

You do need a consumer lawyer, a proper one. Pay for an hour of advice if necessary- not all lawyers do one hour for free.

I would say there is every chance that you may have a claim, but I think it will be a bit of a struggle. I would agree that it's worth taking some legal advice first.

If anyone thinks this is frivolous, I can assure you that there have been plenty of finance agreements entered into, either bank loans or specific finance from specialist lenders for cosmetic surgery. Considering the costs involved, I think they should be protected the same as if you had a faulty sofa.
