Ok I bought an item from them, the payment said it had gone through from my end and they sent the item.... I then receive a barrage of emails saying the payment hasn't been made and that I need to pay and that if I don't they will personally come round to collect the money (from the other end of the country). Although I was sure it had I looked into it and realise ebay have made a mistake and the payment hadn't gone through.

The item arrived and was clearly fake so I told teh buyer \i would be returneing it to them which I did, they now say it hasn't arrived and if ebay don't take up their case they will take matters into there own hands...

I don't know if you've actually paid, OP, I'm a bit confused, but if you have then how did you pay? Credit card or something else? You might be able to do a chargeback through your bank

You'd send it recorded delivery to ensure you had proof that it was trackable and received by the person who has been saying they will come across the country to get the money from you! That's not a dispute?

No I haven't paid for the item. There was no dispute opened through ebay or paypal.

DP sold a car via eBay, six months later the buyer demanded DP part paid for some items which arose from a routine service. The phone calls were threatening, intimidating and frightening. I advised DP to contact the police and they arranged for an officer local to the buyer (300 miles away) to warn them that their behaviour had been 'noted'. We were given a reference to quote, in case the threats were carried out. In the end, the buyer tried to take DP to court, as advised by the 'very helpful police officer', DP disputed the location of the court and it came to nothing.

Call the non-emergency number for the police and ask for assistance.

Not returning an item by recorded delivery = epic fail.

They are not going to turn up on your doorstep.

You won the item, so you are obliged to pay for it. And you should have done so regardless of whether you were going to return the item or not.

Sorry but you are in the wrong. And bay will reach the same conclusion. The seller will report you unpaid, he sent you the item, and there's no proof you sent it back.

are the messages between the pair of you via ebay?

if so that is good as you do have some proof of what has been said and what has happened.

if not then unfortunately I think from ebay's point of view all they will see is a non-paying bidder and a missing item :(

There is no proof either that the seller sent the item they never sent tracked.

Worse case scenario here is the buy gets shitty messages and gets an unpaid item strike.

STill no reason as to why the payment did not go through.

If the seller has the incorrect email address on the listing it is their fault they did not get paid, it is also their fault for sending an item that had not been paid for. It could be said that the seller sent unsolicited goods as they were not paid for.

It is ridiculous to return an item and not send signed for though.

Then why is not now not paid for? As once you have paid the only way to get your money back is via a refund or the dispute process.

Was it showing as a completed transaction in your PayPal - eBay did have a problem a couple of weeks ago with things showing wrongly paid/unpaid.

No, not showing as paid in paypal, just in ebay. I said I didn't want to pay for it as it was fake, I would rather return it.

The glitches are PayPals not eBays.

I have given you links to report the emails and to obtain the number for eBay.

If you want to take it further you can.

If the item was showing as paid for you will have the PayPal receipt in your email inbox you may need that to prove you initially paid.

It's a complicated case! I do think the seller should have checked his PayPal when he printed your address label though.

Did you get written confirmation from an approved supplier or Trading Standards that it was a fake? That is the only proof that eBay accept. If it was TS then they would have taken it and destroyed it anyway.

It does not matter whether she got proof or not as she has not opened a dispute, and she cannot open a dispute because officially she did not pay.

eBay do not require proof an item is fake, they request the seller proves the item is genuine, it is only PayPal who require proof.

So if you have an authenticity claim you only ever go via eBay as the onus is on the seller to provide evidence not the buyer.

Agree that the very least you should always have is proof of postage, signed for delivery is better and 'Special Delivery' is best of all as you are insured for most things and Royal Mail will properly investigate claims of non or incorrect delivery.

The only time as a seller I have ever had a problem with a payment not going through was when a buyer paid me by echeque?? I have never had this before so PM'd them to let them know that the payment wouldn't clear til whatever date ( about 10 days after the payment was sent) but I would send the item as soon as payment had cleared - the buyer did not PM me back to acknowledge my message - clearance date arrived, echeque still hadn't cleared and the buyer cancelled the transaction - cheeky fucker! Without even a word to say what the problem was .... grrrrrrr

I've had exactly the same thing when I was a seller with echeques Cannibal.

After I'd got wise to it (and had a couple of buyers getting shirty with me about not getting their stuff), I used to email the buyer to double check they knew they were paying with this method, and they had no idea!

I still don't understand why/when an echeque would be used, I used to think it was when they didn't have the funds but perhaps had some cash pending, but apparently not.

Weird.

I'm not sure I understand this full thing but I think the moral of the story is, recorded delivery is only about a pound dearer, do it every time!

"signed for" is 77p whether first or second class , standard parcels can not be "signed for" so need to be first class or use collect+ it requires signature and is about £4-5 for upto 5kg it covers you upto about £47 ( cost of a 100 first class stamps)

special delivery is about £5 and should be used for money vouchers coins etc or things more than £47

as a seller I tend not to use signed for unless worth more than £25-30
