beautiful new house, we saw it and loved it and made and offer which was accepted. we then went through the application process. i passed, my dp didnt on the basis he is on a temporary contract Sad but then we are told the land lord get the last word and can sign a waiver. the landlord agrees to this if we agree to two months deposit.
its a stretch but we agree because we love the house and want to offer some security and build a good relationship with the land lord who was burned by the last tenants.
all is agreed, then the land lord has a wobble and decided that its not ok and now want 6 months rent in advance.......that would be about 12 grand give or take aibu to think this is ur. if i had that kind of money to hand i would be buying not renting and whilst i understand that they have had bad tenants previously and are offering us a chance rather than just saying "no we have changed our minds" this is a really odd demand?

apples no we havent yet so i guess she may surprise us & give it back. i just doubt it due to her personality iyswim? she has made every little thing difficult, as much as she can. we're moving in a couple of weeks

Firawla: You are like most tenants between a rock and a hard place. Part of the legislation states that three times the deposit can only be applied ??.if the tenant? and one judge in his wisdom decided that if you have left the property you are no longer a tenant. You already have doubts due to her actions and you are right to be concerned.

Forums are full of LL who once the tenant vacates refuse to return the deposit. A friend was charged £840 (out of £900 deposit) for cleaning and I can assure you the place was in better nick than when they moved in.

So what do you do? Hope? Prey that she has a heart and plays fair? I personally would just not pay the last month?s rent and especially as she has not protected the deposit in accordance with the laws of the land. Which goes some way to showing her real character? As I mention before show me one good LL and I will show you a thousand bad ones.

As you are leaving in a few weeks that option is not open to you. So I would suggest you get her round proton to inspect the property and accept that she is happy in its condition. Record the conversation and indeed have her provide a written statement to that effect and secondly should the condition not change she will be there on moving out day with said deposit, in cash, so everyone knows where they stand. Others have done this though only for LL not to turn up till you have left and still don?t return the deposit. As I have said they are maggots who believe there are thirteen months in the year and not twelve. A way around this is to make DH/DP big brother stay at the property when you have gone and when LL tried to enter block their entrance until the money is paid in full. It is still your property and it is not a police matter but a civil one. She will get the shook of her life and given the under handed tactics let her know that you have not vacted and that only a court order can make you leave which those silly LL think it takes 2 months but I have personally starched it out to 9 months and that will make them think again. I think it's standard.We had to pay 6m rent in advance because DH is self employed when we were 'between houses' luckily as we had sold one we had the £

Firawla.

If you have a complete and signed inventory for your tenancy then all you have to do is to return the property in the condition in which it was stated when you took it over. ideally with pictures. If it was clean for you, get it at least as clean for when you hand it over.

Go and talk to the CAB and see what is what. Take a copy of any inventory you have, and tell them your deposit is not as yet protected. AFAIK, LL can't evict you if there is no deposit protected, but if you have handed in your notice, that is different.

If your deposit is substantial, then consider getting an independent inventory clerk do you a check out inspection/report so that you know areas that need to be addressed by you before your official check out.

Oh and who was it that said that the security deposit belonged to the LL? What utter bollocks! Clearly a crappy landlord! It's the tenant's money, and never stops being so. it's a security deposit to be claimed against in the event of any accident or damage.

In order for the LL to claim any of it, through the dispute system, they have to PROVE that they have a right to charge x, y or z. If they can't, they don't get to keep it.

I had a LL that tried to do me for over half my deposit, nearly £500 in all. I did a statutory declaration ,sent all the documents I had off to the TDS and they ruled totally in my favour and were scathing about her behaviour.

it is a bit complicated in our situation, because nothing seems to have been done properly at all. i dont wanna take over the thread too much with the details cos im sure i could moan about her for ages! might have to make my own thread about her later on, but herhissyness i think you were on my thread about her and her mouldy washing machine before? dont know if you remember it

Hi just wondering how much rent people pay I live in London and my rent is £149 per week and council tax is £25 per week it's council not being nosy by the way

Hmm.. if he is taking the p now, what will he be like 2months in when something needs repair, or when you move out and there is an imaginary 'scratch' somewhere. Who on earth has that kind of money up front these days - grabby beyond belief. That would put me right off tbh.
