Passport issues pls read

Ok, so if you wanted to take a child (your child) on holiday with you do you need the father to countersign? Father is on the BC, and was born after dec 2003.
If the father wont agree to sign the passport or give written consent is there anything the mum can do other than suck up and hope they will eventually agree?

If you do not have a contact or residence order then you CANNOT take a child out of the country for a holiday without the consent of the NRP, if they have parental responsibility. If they refuse to give consent, there is only one recourse and that is to go to court for a Specific Issue Order to allow the holiday to take place, you will have to do this for every holiday.

If the NRP is as much of an arsehole as my XP he/she may even have rung the passport office and asked them to watch out for you trying to take the child out of the country without his/her permission. If you try this, you can be arrested. Not a good plan. And the passport office will not - cannot - tell you if the NRP has done this.

hmm Teddies i take both my dc in and out the country mostly without being questioned only occasional does someone flag up the differnt names .So i carry cope of dc bith certifcate that shows my maiden name and my married name ( i reverted back to my maiden name )

I have always applied for my children's passports on my own. My ex doesn't get involved. All I have to do is give his basic details on the application form.

He probably likes not getting involved so I get stuck with the cost.

I have taken the kids in and out of the country without any problems. We have different surnames.

Equally my ex and his girlfriend-du-jour have taken the kids in and out of the country for excursions without any problems.

I didn't fill in DS fathers details other than info I got from BC. He also lives abroad but is a british citizen.

I had other issues though, they are really strict atm. DS name is changed by deed poll, both parents have to give permission for this but it is changed under my order only iyswim? The passport office accepted this but I had to prove by letter signed by us both that DS isn't subject to court order supervision, isn't fostered and lives with me.

I did say I hoped they checked with every parent that they had the right to have their child living with them and to prove it. didn't go down too well. Grin

There are ways around it - if you ring the passport office helpline they will advise. Just be sure you get all the info first time which I thought I had it saves a lot of hassle.

IIRC as long as you can prove you are returning then you can take your child.
