Bloody estate agent...

We received an email a few weeks back saying our landlord wanted to sell our rented flat. They wanted us to have a rolling 2 month contract until they had sold. We have a 9 month old so said that we would find somewhere else as we need to be more settled, anyway we agreed on a 6 month contract and the landlord would put it on the market at the end of the contract.

We have since then found somewhere else and given 2 months notice. Today we get a call from the estate agent saying we have to give 4 months notice not 2. It clearly says on the contract "2 months notice must be given" She says that means 2 months at the end of the contact???

Is she wrong??

It sounds like you've signed to the end of the 6 month contract, I'm afraid.

But look at the wording carefully as they could have made a mistake in what they wrote.....

I'm not a legal expert, but unless it says something like 2 months notice must be give at the end of the 9 month contract then I think she is wrong. 4 motns seems like a very long notice period on a 6 month contract!

That's it. If it had said 2 months at the end of the 6 month contract we would of never of looked for something else!! We have spoken on the phone a lot too and she never mentioned it.

is it a 6 month break clause though? We rented and it was a year contract with a 6 month break clause, so the earliest notice could be given was at 5 month (1 month notice) this was clearly stated in the contract

No we agreed at the end of 6 months we would move because she wants to sell. Its an Assured Shorthold tenancy.

If you're on a 6 month fixed term ast you don't have to give any notice (although it's polite to). You are committed to the 6 months though
