Dear Mr H

I am writing to you with regard to the £1040 you owe myself.

I have sought legal advice and have been advised to give you 7 days to return my deposit before legal action is taken.

If I am forced to take legal action to recover my deposit, it will be accompanied with an application for compensation for the illness caused to myself and children by the substandard conditions you left us living in.

I have already provided Shelter, Southwark Council Environmental Team and my solicitor with copies of the photographs I took over the years. I have also supplied them with the email correspondnce between ourselves where you promised repeatedly to have the repairs carried out.

They also agree you left us in substandard conditions and I am entitled to a large sum of compensation. I will persue this course of action if need be to recover the £1040 you owe me along with the compensation I am entitled to.

I will happily avoid this if you return my deposit within the next 7 days.

  1. Change "myself" to "me"
  2. Typo in "correspondence"
  3. "Pursue" not "persue"

(btw you'll be lucky to receive compensation for illness unless youhave very strong medical evidence - I'd be inclined to sue for the fixed sum under the Small Claims procedure).

Paragraph 4 correspondence
Paragraph 5 pursue

I can't advise on legal matters though, sorry. I think it is plain and to the point, which I presume is what matters.

Ok back story is

he left us in substandard conditions, damp, mold on arpets, walls falling down shower door fell off runner and onto ds1, bath flooded cellar so couldn't use it often, sink in family bathroom was broken, ensuite bathroom shower flooded my bedroom everytime it was used, Wall in ensuite and DS1's bedroom fell down due to damp, courtyard repeatedly flooded DS1's bedroom.

there is more but i would be here all day!!

I have since moved from the property into a council place, HB paid landlord for period of December 27th - 16th January. I was unaware of this and he said to me, I will take it out of the deposit. So I went along with it.

It now transpires he had the payment from them and kept my deposit. Which I want returned.

I have sought legal advice and advise you that you have seven working days, from today's date, in which to return the monies otherwise I will pursue the monies via the courts. If I am forced to take legal action to recover my deposit, it will be accompanied with an application for compensation for medical problems caused to my children and I, due to the substandard conditions of the property.

I have already provided Shelter, Southwark Council Environmental Team and my solicitor with copies of the photographs I took over the years and they are in agreement that repairs should have been carried out by you, but you failed to instigate this. I have also supplied them with copies of email correspondence between you and I where you promised repeatedly to have the repairs carried out.

I'd leave out the bit about a claim for compensation if the don't settle as effectively you'll potentially be seen accepting return of what is yours (the deposit) as agreement to drop any future right to claim. There's nothing to stop you still claiming compensation if you get your deposit back but their lawyers could potentially have a field day with what you've written at the moment
