to sue the council?

My 2year old DS was taken to A&E last night with two split lips a bruised bloody nose, a bruised cheekbone and forehead.
My DH had taken him out in the buggy to get some shopping and walking up a pavement he tripped on a pothole and the buggy ended up tipping forward with my poor DS under it.
I'm so angry because the pavement is is a state of disrepair and it's soo dangerous, I keep thinking what if it was my 4mth old dd in the buggy instead? AIBU to sue the council not for the money, I don't care about that, but so they will finally fix it?

The worst thing about it is 6 people walked past, saw what happend and saw the amount of blood and didn't even offer any help, just stood staring BASTARDS!! Angry

Yes he was strapped in, although if he weren't he probably would of hit the concrete face first.

Talk to your local paper. There is a website where people can log potholes and councils are supposed to fix them within a certain time period I think. Hope your son is ok now.

Can't see how suing would help an already cash strapped council but definitely I would go to the papers to shame them.

Definitely call and email the council, today, and report the pothole and the injury so that they can make sure it doesn't happen to anyone else. Also copy in your local councillor/s and parish/town council if you have one. Make sure that the highways team knows that you are hot on the case of it.

As for suing them, I wouldn't. It would just mean that they had less money in the budget for fixing potholes.

Hope your son and DH are OK.

I'm a local newspaper journalist and second talking to your local paper. We find that often having a reporter looking into an issue prompts swift remedies to such problems and I'm not sure the threat of legal action would have the same reaction. I think a story with photos of a toddler's bruised and cut face will really shame them into sorting the pavement out.

There is no amount of money that would make me feel better after seeing my child injured in the way that you describe.

I would report the pothole but not take it further.

I hope your DS gets better soon. But the only winners if you sue are the solicitors who will get a sizeable fee courtesy ultimately of the taxpayer, regardless of any payout you get.

And AIBU to ask why your DH didn't see the pothole and walk around it?

I know where I live that the council spend more every year in responding to claims than they actually spend in improving footpaths - as they have so little money for this.
