Car insurance cancelled as someone has claimed against me.

Can they do that?? Back in November my husband was waiting to come out of a small junction, but his view was obstructed by a van parked on the pavement to his right. He slowly crept forward so he could see, but so that he wasnt causing any obstruction to the traffic on main road. A car stops, as if to let him out, but as he knows the person in the car and knows what he is like he waited for him to carry on. But he didnt carry on he waited and waited and cars behind him were beeping like mad as he was then holding up a fair bit of traffic. Anyway, my husband then decides to give him the benefit of the doubt and slowly pull out, he the car on the main rd put pedal to the floor, causing his car to wheel spin and hit my husbands car. Damage to our car was a slight crack on the bumper, so as far as I know his couldnt have been much worse, there wasnt much speed involved.

DH got out of the car things got heated, but they each went their separate ways.

After an hour or so we get a visit from the police saying that DH intentionally drove into him and then assaulted him and broke his phone, although the police said to us the phone he is claiming he broke is all broken to pieces, but yet he still managed to call from that number. He has history with the police for making stories. Police requested our insurance details which we were more than happy to give and when the police asked for his, he refused.

We phoned our insurance to inform them of the incident, and that we didnt want to claim for a slight crack, but we were told they may wish to claim off us but liability team will get in touch for our version of events.

Heard nothing until 2 weeks ago I was checking our policy online to see how much we would need to pay to have me put on the policy only to find a claim has been paid out with costs not receovered, so in otherwords against us.

Other driver has since has his car taken off him, as he was fraudulently claiming DLA, and was using to deal drugs.

We emailed insurance to see why the claim was against us, as police were informed of witnesses etc and we weren't told. They were supposed to ring me back on Friday, but didn't.

Today I received an email saying they were excercising their right to cancel the policy. A phone call to them revealed that because of the claim in November which involves a 3rd party, they have cancelled it. Can they do that?? I have paid £600 in monthly payments since the incident

When I paid them my last payment on friday it meant I was insured until 18th June. I had no idea they could cancel my next 4 months even though I have paid it.

Even if they can cancel I'm pretty sure they would need to give you a pro rata refund - they can't have it both ways.

so ask for a refund

don't get the problem really there

your problem is having an uninsured vehicle and now having to say that you've been refused insurance when getting new quotews - that'll hurt

Its just the fact that I feel they waited to get my last payment and then they stung me. But they didnt even tell me there was a claim being made against me. Surely that means anyone can claim against anyone else without them knowing! They didnt offer to repair our car in the process surely if they do his they should do ours? Not relevent really though as its a crack in the bumper about the length of a 50p piece.

You need to speak to them about the pro-rata refund, they technically owe you four months premiums you need to discuss with them.

Are you fully comp and did you make a claim? They won't offer to pay for repair if you didn't claim.

Yes we are fully comp and we phoned them told them what happened. We told them we didnt want to claim off our insurance but they said they could claim off his. Told them I wasnt bothered as to be honest a small crack isnt worth the hassle of being without a car or having to wait for courtesy car etc.
