I shall give you two options for this thread, as I'm aware I've gone on about the same subject for months now. So short version and long version.

Short
Landlord is a wanker. An aggressive, threatening bastard who has made it impossible to live in our flat, yet we've still had to pay him rent. We move the last of our stuff out this month and I already know he's going to be a cunt about the deposit, so should I really bother cleaning? The place isn't a dump by any means, but it isn't spotless either.

Long
Landlord refuses to fix things, like a giant hole in the wall for example. So we call environmental health, who obviously aren't too impressed. Landlord gets annoyed and turns up at the flat to threaten us for it, not just once but twice. Second time he stands banging on the door and yelling abuse for 15 minutes.

The first time he got in as DH didn't expect him to be aggressive, he thought that the landlord was actually going to bother fixing things. While there he accused DH of cracking a window, claiming he saw him do it while they were stood there. The crack had been there since before we moved in. So we already know he's a bullshitter.

Which, to me, suggests our deposit is long gone. I know there are rules in place, but we've had to fight for our deposit before and lost - and this was after properly cleaning! The flat was cleaner than when we moved in!

We haven't stayed at this flat since November, and have actually had to stay on friends and families floors - in totally different counties to our flat! Which is of course expensive as we still have to get back to near the flat for medical appointments etc. Plus feeding ourselves is costing more due to not being able to prepare food and freeze it.

On top of that, we were meant to be staying there for at least another year. And with that in mind had used some of our savings on our wedding (a month before all this started) and a car so I could actually leave the flat and get to my hospital appointments (mobility issues). And due to the cold snap we had to leave heating on low so that pipes didn't burst - even if we weren't there. And lights on a timer so that it still looked occupied.

The flat isn't spotless, but it isn't grim either. It's a bit dusty as we haven't been there to clean it, and the carpets could do with a professional clean (no stains, just the usual dirt accumulated, especially after moving boxes/furniture out). But that will cost us further, when he's already had 3 months rent for an empty property. And we are already out of pocket.

He's told our friend (who turned up to try and move him away from our door when he was yelling at us) that he thinks we are "dole scum" (both disabled) and he expects us to wreck the flat. So she thinks we should deep clean it to prove him wrong. She thinks it will annoy him. I get the feeling it wont somehow.

Extra money + pristine property + he'll probably find some excuse to not give us our deposit back = him laughing I feel.

Quite frankly I'd like to stick up a sign saying "fuck you cunt features" when we leave, though I will obviously not do that.

So really, AIBU to not clean the place? I'm well aware I'm very emotional about all this and would like some more logical/detached opinions.

Give it a reasonable clean, and take photos of the state you left it in.
As the other poster suggests, make sure you can prove the day they were taken (if you do not want to trouble a 'witness', make sure that that day's paper is at the front of each shot.

If there is trouble over getting the deposit back, be prepared to fight the git. If he is particularly stupid, he will take photos of his own, complete with damage.

Your photos will blow him out of the water!

I am not sure kaloki from your replies whether your deposit has been protected in a registered deposit protection scheme? If it isn't you can go to court to claim back 3x the amount of deposit and you should win without a problem, the landlord has put himself very much in the wrong in this case.

If it is protected you will need to go to arbitration through the scheme, my experience has been that the tenant is very much favoured but this may only be for certain schemes.

If you cannot resolve through arbitration you can then go to court, I know you said that you cannot face this but serving papers on him is piss-easy through the government on-line money claim service (there is advice on the site on filling out the forms). As far as I understand in these small civil cases it will be a small hearing with the two of you and a judge. Begin undermining his case, for a start, by logging his aggressive behaviour towards you with the police.

The housing charity Shelter gave me very good advice when I had an awful situation with a 'difficult' landlord. I won my court case by default (he didn't respond to papers) and I got my deposit back.

Yep, deposit is protected. Sorry thought I said. However the deposit was also protected in our previous property and we lost most of it :( So apprehensive about it.

I would have it professionally cleaned at fight. Make sure you take plenty of photos before you leave and keep receipts for the cleaning/improvements.

Okay, TDS were shit for us but it might not be the same for you.

Dont give the arsehole the excuse he needs for keeping YOUR money.

I'm not sure what cleaning cost you are looking at, but why pay hundreds for a professional clean when you can hire a carpet shampooer which will do the furniture (if furnished) as well. I've been a bit boring about this on various threads, but if it brought up our beige carpets (DS had vommed, there was dirt tracked in, etc.), you should be able to make a real difference without spending a fortune.

As for this bollocks about professional cleaning only to get your deposit back, which other posters have mentioned, I think that's bloody immoral and potentially just a big kickback scam.

plupervert - most contracts now specify "professional" cleaning for the house and carpets and they do request receipts upon your departure.

Shit isnt it - I forked out about £600 on professional cleaning at my last property and they still kept my deposit.

Why not just burn down the landlord? You could do it in voodoo form (so if "couldn't possibly" hurt him Wink - that's my disclaimer) a big burning Wicker Man!

Have been in similar situation. Cut your losses (and stress) dont clean and just leave, dont even arrange a handover the keys meeting.
Say you are too busy to meet him and will just lock the keys inside the house for him to collect.

Clean it properly yourself, have a proper check out inventory done and then if you have to go to the tenancy deposit arbitration, you will have proper evidence of the condition at the start and at the end of your tenancy.

We just moved out of the dlat where we lived 2 years. The landlord does not want to give a part of deposit because the flat was not professionaly cleaned! We left it cleaner than it was when we moved in! It doesn't say in the contract that it has to be professionaly cleaned. It only says it has to be left in the same condition as we moved in. When we moved in there were mould on the bathroom walls, that i was cleaning myself, but if course the stains were so old so was imposible to clean it. And now the landlord is saying that it is our fault and we had to inform her when we noticed that. So she will charge us for that now. Is she right?
