to open paypal dispute for ebay dress that didn't arrive?

I bought a dress for £60 2 weeks before xmas, it didn't arrive but I believe the seller sent it, they have 100% f/b and replied to all my msgs straight away. They have said they will make a claim with Royal Mail on my behalf but I have heard this can take ages, should I just open a dispute to get my money back?

I thought they had to refund you and then claim .

I wouldn't tbh, the dress may still arrive and it sounds like the seller has been more than cooperative/helpful.

If nothing happens in the next couple of weeks, revisit it.

If the seller did send the dress, and it's Royal Mail at fault, then the seller shouldn't be out of pocket as a result.

Given the poor weather situation the dress may still arrive. Sounds like the seller has been very reasonable i would only use the dispute if they were refusing to help.

Be careful though a claim can take a while through the post office and you only have a limited time to file a dispute so if they decide to go back on helping you you will be stuck with no dress and no money. Keep an eye on the time if they are not prepared to refund before a claim.

Was the item sent recorded? If not it seems unlikely that they will get £60 reimbursement as there are limited values for 'ordinary' post.

Claim now there is a 45 day time limit and if the dress turns up you can always pay them again . Unless they sent it recorded most they can Claim is £32 but that's their problem as is their responsibly to get the dress to you.

By the time you wait for the seller to sort out their claim with Royal Mail, you will run out of time to open a Paypal dispute. Off the top of my head, last time I claimed for a lost parcel I had to wait 28 days I think before sending off the form to Royal Mail.
Your seller should have used a trackable method of carriage to protect themselves, against lost parcels and also Paypal disputes. Even if they sent the dress by first or second class post, they may have paid a little extra to insure it for full value. I sometimes send cheaper items by regular Royal Mail, but if one got lost I would shoulder the responsibility, refund the buyer, and then claim for the lost parcel from Royal Mail. This is what your seller should do. If they don't you really need to open a Paypal dispute, which they will lose because they didn't use a trackable delivery service.

If an item doesn't arrive the seller should always refund the buyer THEN make a claim with Royal Mail.
If the dress turns up you can let them know and re-make payment.

p.s. Whether or not they took out extra insurance for the full value of the parcel, that is not your problem. You get the refund, they claim for the lost parcel to get their money back. I'm an Ebay seller of nearly 500 items and have done this several times now, as Royal Mail is pretty unreliable.

you can start a paypal dispute now to get the ball rolling..

you can cancel this at any time if the item does arrive.

The seller needs to wait 15 working days before they can claim through Royal Mail.

I recently posted a dress on eBay and the buyer claimed it did not arrive. I asked her to wait until that time period had elapsed but promised a full paypal refund if it did not arrive by then. It did turn up.

I agree that the seller should refund via paypal and then claim back on Royal Mail. It take ages.
