to be livid DH has to work with D & V?

We all have it, ds school has it and dh started throwing up last night . Dh isn't allowed any more days off after taking some when I was ill, but he text boss saying the above i.e its v contagious but he's going to work and he replied "ok". There is about 50 odd staff and his co worker has JUST had a heart attack.

Your DHs employers can't not allow him time off. They may not pay him, depending on the company policy, but they can't prevent him having the day off.

If your DH texted saying, "I'm sick, but I'm coming in," he took the initiative here, rather than his employer forcing him to work. His boss probably thought "Oh, he can't be that bad then," and didn't think through the implications.

I'd be furious if i had to sit next to him.

Well I had a heart attack last year and cancer with all that that entails (chemo, RT, etc) this year, and if someone in the condition your DH is in came into work and worked close to me, I'd be furious.

Of course he's allowed time off work. What I assume you mean is he will perhaps be disciplined if he takes time off work. Well I reckon the health of his co-workers comes before the fact he faces disciplinary proceedings.

Tell him not to be so daft!

He's been told he will be sacked even though gp said he had to stay at home when I was ill. He wants to come home but will be in big trouble. It's a massive company too

I thought it was not allowed to sack someone on grounds of illness? It's not like it's a chronic progressive thing, it's D&V which will (hopefully!) be better in 2 days. Are his employers contravening the H&S act and can he take them to a tribunal?

He absolutely should not take D&V to work.

YANBU and I would be livid too.

They won't sack him over this. It is really hard to sack someone unless they have a proven record of naughtiness. He should never have gone in - Dr's note would be needed incase they try to be bullish.

There is no way on earth they can sack him for taking time off for D&V.

Anyway, I'm sure he'll be happy when his colleague with the heart condition gets the same thing at the weekend. Bear in mind for someone just over a heart attack D&V can be fatal.

Tell him not to be so bloody selfish!!!!

How long has he been working there? If it's less than a year they don't even need to give a reason for sacking him.

I am disgusted by his boss. If I was one of those 50 employees I would be furious. The boss is going to end up with about half of them off on Monday or at least half of the puking in the toilets rather than achieving anything.

He's been with company 2 odd years , present role less than a year. He said to his boss he didn't think he should be here esp. literally working next to the guy who had a heart attack and only been back a few days!

Could he not have offered to work from home? Or quarantine himself in any vacant meeting room.

Is your illness ongoing? If so, have you got some kind of cover sorted out for the next time?

If not, your DH needs to discuss what happened with HR, and provide a doctor's letter if necessary.

Why the hell would an employer want someone in the office who was puking their guts up and running to the loo every 5 minutes? Unless he's doing a job which is completely essential and can only be done by him, I can't see what the employer is possibly gaining from this situation. He's not going to get much work done is he? And will end up infecting/grossing out everyone else. Not to mention the poor guy who recently had the heart attack. NOT good.

He works in basically a reception, out and about on site etc. , he can't tuck himself away. So potentially he will be infecting all the drivers, postman , engineers,

I think your DH is being unreasonable tbh. he just needs to say he is ill and is not coming in. It shouldn't be open for discussion. There is nothing the company can do and they certainly can't sack him!

his employers are short sighted asses - the company will probably pay for this with other employees coming down with the bug. Sad & unnecessary for them but perhaps the ASSES in charge will learn a lesson. And your poor DH having to have a day like this ..........Sad

I have great sympathy for your husband. My employer is pretty draconian about sending people off to occupational health/kicking up a fuss if you have too many sick days - as a result I end up being sick on my own time (i.e. taking annual leave). It's all very well for posters to say "they can't sack you for being ill", but believe me, in the current economic climate no-one wants to be top of HR's "unreliable list" when the redundancy decisions are made. Having said that, if the guy on the next desk has just come back to work from having had a heart attack - I think your husband should at least try to get his boss to shift him to work in a different bit of the office for a day or too.

It's very difficult to sack someone once they've been at a company for over a year. Even if they try, there are procedures that have to be followed.

Your dh shouldn't have gone in. I'd be furious if it was someone at my work. I don't get paid for being off sick, my dh is self employed so he wouldn't either and then one of us would have to take further time off if dd caught it too.

I dread d&v bugs tbh!!

D&V is horrible. Worse for self employed people as we lose money Sad and don't get sick pay at all.
