I live in flats backing on to my daughters school playground, it's nice to hear the kids outside getting fresh air. I'm shocked the school backed down, I would be furious if I was a parent at that school no way would I put up with it!

Oh FGS!!

Whatever next? Using duct tape on cows and sheep to keep them quiet so those who live near a farm (like us) can live in peace?

So if you live near a pub, (like us) you'll get noise from the beer garden and at chucking out time and should expect this, no?

If you live near a church, (like us) bells at service time and should expect this, no?

If you live near a school, (like us) children walking past, laughing and chattering etc, and should expect this, no?

It would be interesting to know how many of those who complained have children at that school.

Just bloody stupid.

sounds about right for the area to me. Hmm
Selby district council made my life hell for 3 years, cuminating in me having SS involvement as it was decided that my children being in out of school club from 7:30 till 6pm meant I was neglecting them, fortunately thier accusations were shown to be unfounded,I moved away shortly afterwards but at the time it was a very stressful period of my life!

personally I love the playground noises :o

minibmw2010 · 17/09/2010 18:24

The school and council should be ashamed of themselves for having given in to these petty narrow minded people !!!!

elvislives · 17/09/2010 18:25

I can't see why the council is taking any notice of these complaints. Our council's website says

How we deal with the complaint will depend on the type of noise, how loud it is, what time of day it takes place, how often it occurs and for how long it goes on. Each case is decided on it's own merits and is assessed according to what a reasonable person would accept.

Complaints we can deal with under Statutory Nuisance Legislation

* Loud Music
* Barking Dogs
etc

A statutory nuisance is prescribed by law and is either ?prejudicial to health or a nuisance?. Basically it must be persistent. A noise that occurs very occasionally or is of short duration is unlikely to be a statutory nuisance.

Things we cannot deal with formally include:

* Slamming doors
* Household appliances
* Noise from children
* Hard floor noise
* Shouting

Can't get plainer than that. On what grounds are they taking the complaints seriously?

I am astonished that the school felt they had to do this. Surely they should have just faced it out. I can't believe they could really have lost the case.

bluebump · 17/09/2010 19:36

How miserable!

I did feel sorry though for the people all those years ago who apparently bought the house behind our halls of residence and didn't do any research into what the nice quiet building was (summer hols) and by the time they moved in it was heaving with about 50 students blaring their music at all hours!

So if you live near a motorway they would stop traffic, a hospital, switch off the sirens and jeez oh what about an airport, can the planes glide in....madness, the world has gone bonkers.

SanctiMoanyArse · 17/09/2010 19:41

We are between a school and a Church (along with a few houses, not sandwiched!)

Lots of noise

It's fab! Church bells, children laughing.... wouldn't change it for the world. there's also an ASD unit opposite which is nopisy and so what? Not noisier than my lot I would lay money!

It's ridiculous and should be laughed off as the work of the nimby.

GothAnneGeddes · 17/09/2010 20:28

It sounds sound like it contravenes the UN Convention of the Rights of the Child, which clearly grants children the right to play for leisure and developmental purposes.
