Self Employed Don't get Statutory Adoption Pay - HELP!

Hi
I am self employed and about to adopt a little girl.

A petition has been set up on the No 10 website as those of us who are self employed are not eligible for SAP. We would get maternity pay but we are not eligible to get SAP. If we were employed we would get leave etc but not if we are self employed.

This is clear discrimination and we need lots of people to sign up to this petition to get the governemnt to play fair. They are actually going against the principles of the international treaty they have signed.

If you think this is discriminatory please go and sign and let others know. You do not need to be involved in adoption. Its a matter of principle!

Good luck with the adoption carbear - how exciting for you even if you have to live on the bread line thanks to govn policy.

Mat pay is a pittance for the self employed at any rate but at least we can access it. Hope the petition works.

We are trying to adopt too, have panel at the end of July!! Fingers crossed for you and is too !!

That's also a lot of other rights too. I certainly had no entitlements when I had the twins as I work for myself.

But if you get a maternity allowance payment as self employed because of your NI contributions then you ought to get the same when you adopt a baby. Does the mother or father get it? It's not quite the same as if you've given birth so presumably should be sexually neutral

Xenia - you can opt for either parent to get adoption pay/leave but can't split between the two (which seems unfair). Also you do not get enhanced adoption pay at 90% of salary for sfirst six weeks, justthe statutory £108.

but OP is right no entitlement to adoption pay based on NI if you're self employed. It is an anomaly.

The government has said that it will make a change in the law so that couples can split maternity leave between them where the mother returns to work before the end of six months. They say they aim to do this before the end of this parliament.
Unclear (to me at any rate) how this will work if the mother is self-employed and the father employed.
But it's another thing that has the potential to have a discriminatory effect on adopters.
Might be worth (if you're not on it already) notifying the EOC of the discriminatory effect of aoption pay if you are self-employed?
