can anyone advise on school admissions please

My DD is y4 and has had a difficult time in a mainstream school
School do say they can 'manage' her but I am being called in a couple of times a week and they are ringing saying we must be available to pick her up at short notice
She is having a horrible time socially and, IMO, there are now deeply entrenched class behaviours with her at the bottom
We live semi-rural and she gets verbally abused outside school from a core group of children (parents let them roam freely)

School say they will support a move and I think they are at the end of coping. I want her to thrive and not be managed
She will need to travel out of catchment if she changes school
I can only see one possibility for her, an enhanced mainstream. It is oversubscribed and full for her year group
I understand there are different rules for previously LAC. She has a whole time statement

If she has a statement of SEN would that get her in more easily than via the LAC rules? The LA cannot refuse to give you a place just because a school is full if you want to name it on a statement.
Pop over the SN children board if you want advice to get her in via the statement Smile

A statement of SEN means that a LAC or former LAC must follow the rules for a statemented child rather than a LAC or former LAC without a statement.

Unfortunately, this sometimes means that schools can refuse to admit a child on the grounds that they cannot meet their needs, as they can for all statemented children.

Ok, a few things:

  1. Sending your DD home from school/getting you to pick her up could constitute an illegal exclusion. Are these official fixed term exclusions? Are you receiving an exclusion letter detailing the length and reason for the exclusion each time you are asked to collect her? If not, this is an illegal exclusion.
  1. When was her last statement review? Have they held an emergency statement review in light of her current difficulties? Have they informed the SEN team that they can no longer meet her needs?
  1. How old is your DD?

To get her a place at the other school, you need to request a change of placement. Contact your home council's SEN department for advice on how to do this. They will send her paperwork to the other school and the school has 15 days to respond. If they say they cannot meet her needs, the SEN team must decide whether they consider the schools concerns valid. If they do not, they will inform the school that they must take the child and name the school on the child's statement.
