Can Sky charge me for leaving contract early if they cannot transfer my broadband?

I signed up for sky broadband around five months ago so still in contract. I'm moving on Monday so called them to tell them I was moving and could they transfer my broadband to new address, she said she can't do that due to them going full fibre, I told her I would need to get permission to get it installed, asked what happens if I don't get permission and she said I would need to end my contract and I would be charged for leaving early. Worried now as I'm moving with the same landlord who already refused permission to get it where I am now.

I understand getting charged if I just wanted to randomly leave sky broadband mid contract but is it right I will be charged if they can't transfer my broadband to my new address? I see it as five months ago I signed up to sky broadband, I didn't know I would be told i would need to go on full fibre five months after signing up and it's not what I signed up for, if they can't move it to new address then they can't provide what i signed up for? or am I looking at it wrong?

Wanted to ask before I call them back.

Yes they can unfortunately. Virgin Media do the same.

They'll argue that you chose to move and to a house they cannot service, so you're leaving the contract early.

Yes they can unfortunately. It's not Skys issue that your moving house- so in their eyes you've broken your contract. I don't understand why your landlady wouldn't want fibre installing though?, i cant she that she'll have much choice soon!

never had sky, but virgin media definitely don’t charge if you are moving to a property they can’t supply, you have to forward proof of new address but they will refund any early cancellation fee once received

That sounds like sharp practice on their part.

Your contract should include your address.

If they can't move the broadband and will charge you, they have an effective monipoly of your business.
