Ex opening my post

What can I do about my ex opening my post?

For context, I do recieve majority of my mail at my new address but some have ended up at our family home where they currently lives. We are going through court for the financial order with the likelihood the house will be sold imminently.

However, I have had post over the past year being opened by them and they have subsequently told me in email that I have received it and summarised the contents (a couple have been debt letters and has made derogatory remarks)
More recently, something very confidential was opened and I was CCd into an email from them emailing the organisation about the letter (they mentioned what was in it and that I do not live there)

I messaged them directly to pass the letter onto me but instead they took a photo of the contents and sent me the photo.

I have repeatedly asked for my post not to opened and happy for a return to sender or forward onto me.

postal redirect for anything in your name - I’ve done in the past and it has been effective

This isn’t right he’s doing that but likewise - I’d have contacted all organisations AND used Royal Mail redirection to make sure this didn’t happen.

Are you with the royal mail redirection service?
If so then is your old home far? 🏠
Can you go into the local royal mail office branch near your old home and take your I.D. with you? ✉️
Explain that some of your post has been missed by the redirection service?

ETA: I would pay for the extended time service, and duly notify all the various companies of your new address, so this can be avoided in future.

As pp have said, the royal mail provide a re-delivery service for this.

Do you a redirection on? You might need to extend it for longer.

It looks like OP has not signed up for the redirection service which is a bit odd because it's the obvious solution to her problem.

As so many PP have said, you need the redirection service, and you need it until you have contacted every single company that needs to know your new address.

He is committing a crime though, and you could ask your solicitor to send an arrow to his solicitor so that they can advise him to stop doing this.

She shouldn't be opening your post - I'm pretty sure that's illegal - but it's entirely up to you to make sure that you have put the royal mail redirect on for your mail. It's not difficult and it's very effective.
YOu can't police what someone else does, you can only control what you do.

No I haven't done the postal redirection. There has only been a handful of letters, the debt ones were the majority and I am unsure how the most recent very confidential ended up in the wrong place.

Do you mean is there anything you can do from a legal view? I suppose you could report to police but I don't know how much effort they would expend on dealing with that to be honest.

How much debt are you in and why? If you're going through a financial order your ex probably wants to know the details as it directly affects him.

Is your debt the reason you split up?

Entirely your fault if you have not signed up for postal redirection with Royal Mail.

Yes, your ex should not be opening your letters but you could have avoided this being an issue with setting up a redirection.

It is rather cheeky to expect them to redirect your mail.

They are also probably keeping an eye on debt collector letters because they are worried that you might have run debts in their name as well...

Sounds like there is a back story here you are glossing over.

About 2k of debt which was accumulated whilst together and already filed in the court proceedings.

I just didnt realise it is my fault some of my letters are opened by someone unauthorised when they could just return to sender?

This is like the person who leaves their front door open and then is surprised they get robbed. it's not their fault as such - you should be able to leave your front door open and not get robbed - but it's also an unsurprising result.

And as a PP has said, debt collector letters which may impact her as well are a not-surprising reason to open the letters, even if they're addressed to you. Again, she shouldn't but I'm sensing more to this backstory.

You can’t stop people opening your post and it’s not illegal in this situation.

Royal Mail redirection is what you need as mentioned

Its not so much your fault they were opened, more that it was your responsibility to arrange for post addressed to you to be redirected.

People often claim it is illegal to open other people's mail but it's more complicated than that.
It's illegal to intentionally open someone else's mail, with the intention of causing harm. Eg id theft.

It's not illegal to accidentally open it or open it with the intention of finding out who you can send it back to aka a reasonable excuse

If hes opening it and using the contents to upset or harass you, you should talk to your solicitor and see if that is something that is covered by the postal services act

You're getting divorced from the man and you expect him to go to the effort of returning your mail? Unless it's a very amicable divorce there was never a chance that was going to happen..

I’ll be honest if I split up from my husband and his mail came here I’d 100% open it. Especially if it looked like debt. I’d want to make sure he wasn’t taking on new debt to my address, as well as just being nosy.

When done without reasonable excuse. Tampering with mail is illegal. Seems to me he is doing it with malicious intent.

I think OP is a man and his ex is a woman and he's looking for a reason to blame her for things.

But even if I'm wrong, OP clearly can't seem to get his/her head around the fact that allowing your mail to continue to go to your old address, particularly when in the middle of a divorce, is something he/she needs to take responsibility for and fix. ASAP.

Tell them if they do it again you will report them to the police, it’s a criminal offence to open other peoples post.

No it’s not, unless the contents are being fraudulently used, for example to benefit the person who opens it to make new accounts under eg the addressee’s name. This is a widely held misconception.
