argos refusing but i didn't get the same product as in the pics they have on their website

I bought a 27 inch pc monitor from argos, opened the outer box (brown plain delivery box, monitor itself did not have it's own box, just packaging around it and two cardboard ends) put the monitor on my desk to plug the speakers into the back of it, when I turned the monitor around so I could see the back of it it was different to the pictures on argos website.

The first two pictures are from argos website showing the jacks, the last pic is what i got without them. basically the pics are not of my monitor, The only reason I bought it was I needed the headphone jack on the back of the monitor but argos are saying I can't get a refund because the box had been opened, if I hadn't opened the box i wouldn't have known they weren't the same as in the pictures.

should i be getting a refund in there circumstances? monitor itself hasn't been used and is pristine and I still have all the packaging etc.

Of course they should refund! They are having a laugh. Have you been into a store to argue with a manager?

I had the same issue with a bed delivery from Argos. The problem they have is the external supplier they use for delivery. They literally just pick up any old stock and rush it out to as quick as possible.

I did have to kick off about three times to get the bed I ordered. Their customer service was shit. Just keep complaining and take it further. It’s not fit for purpose and not what you ordered. Can you find out the retail price for the monitor you’ve got? I bet it’s also vastly different to what you paid.

What does the product description say on the argos website? It might say something briefly on the main page but also look on the product description section. If it says headphone then take a picture (before they update it) and insist they take it back as product not as described under the Consumer Rights Act:

As described: The item must match any description, sample, or model shown to you before purchase.

Argos are horrific for returns. I bought a laptop from them that didn't work and they wanted me to wait weeks for them to send it away to fix it, while I needed it for work.

The next time I bought a laptop I bought it from John Lewis. No quibble, 2 year guarantee. Yes, maybe a little more expensive. But with technology it either does what you want it to, or it doesn't, in which case it's useless.

Tell them that under the Consumer Rights Act 2015 you are entitled to a refund as the item in not as described. The refund must include the cost of the item and delivery costs.

They cannot refuse on the grounds that the box has been opened. As you say, you could not know that the item was not as described until you examined it.

Absolutely you should get a refund. This comes under the Consumer Rights Act (2015). It’s not ‘as described’. In the first 30 days after purchase, you have the right to reject it completely for a full refund. The question is how you enforce that.

Firstly, I’d go back and explain that, if you already haven’t. If they refuse to budge, I’d email their CEO office (companies usually have a team to deal with stuff on the CEO’s behalf). Further down the line there’s the option of chargeback or threatening small claims court.

I don't buy from them anymore because they disregard consumer rights.

It isn't as described, and I don't think just opening a box is allowed to be a reason for non return for such an item anyway.

This is why I avoid buying expensive items from Argos now. They make it so difficult to get a refund.

"The box has been opened" is a favourite excuse they use.

I bought a laptop from Argos and returned it after opening as we realised it wasn’t fit for what we needed. There were no issues

You are absolutely right to demand they supply you with the product you bought but the thing that is going wrong is the use of the word "refund" which they have enormous pressure to resist. What has happened is that they sent you the wrong product and you paid in good faith for a monitor with rear headphone sockets and that's what you insist on being supplied with. Absolutely keep on quoting the Trade Descriptions Act and the Consumer Rights Act 2015 and keep on asserting your rights but put the ball in their court to send you the correct item. If it's their conclusion that they cannot do so and they decide to refund then it's a totally different process and probably a different department handling it.

To be fair, headphone sockets like that are pretty much obsolete and very few people still use them. They may be as bemused by your insistence as they would be with a person insisting on buying a PC with a floppy disc drive. But that's beside the point, they advertised a product that you wanted and you have a right to receive that product or have your money back.

I would ring up the head office and complain that way.
Also leave a bad review.

I will never buy from anywhere that doesn’t make things easy to return.

This has completely put me off ever buying from Argos.

Argos customer service is awful. I had an issue and the store would not help so I had to go through twitter and even this took days of messaging before the issue was resolved.

And it doesn't mention there being headphone sockets. There is also a question from 30th May asking if there is headphone output and the answer is no. Is it just the photo which made you think thee are headphone sockets? Looking at it, to me it isn't at all clear what they are (but I am on my phone and can't make the pic very big). I suspect Argos might argue that as the description doesn't mention headphone ports, you can't expect there to be any.

Definitely get a refund. I had a similar problem last year with a chest of drawers (size much smaller than advertised so not fit for purpose) and they refunded it with no problems. Try their online chat, they're usually helpful

Looking at the photos on the product listing, you can clearly see the headphone outputs. The photo you’ve taken of the monitor you’ve received, shows no headphone outputs. They’ve sent you a different product to the one they’ve photographed for the product listing - even if they’ve sent you the correct model as per the listing. You should be entitled to a refund here.

You should, but I suspect they'll say you should have read the description (which doesn't detail the two ports that are missing) rather than relying on the image.
