Can I claim through MIB after an e-bike hit my car?

Just looking for advice please.
I was driving along a main road near to my house and out of no where a guy on an e bike came out from a pedestrian side street and crashed into my car, knocking himself off and damaging my car in the process. I did an emergency stop and before I could even get out the car to check if he was ok, he was gone out of sight! I'm still in shock, it was awful. Luckily I have a witness, who was sat at the bus stop and a CCTV camera from a nearby shop. I obviously didn't get his details, not that he would have insurance anyway. I'm sure he was exceeding the speed limit allowed for an e bike (15.5 mph)
I called 999 straight away, but they didn't want to know. I've reported online as they advised and called my insurance. I'm expecting to have to pay my excess of £500 at least. Would I be able to claim through MIB? Has anyone had a bad experience with an ebike? I'm honestly so shaken up with it all and devastated that my car is in a mess too. My two little boys were in the back, only 8 years and 11 months. My baby was so upset and frightened as he made a huge thud against my car.

If it's an ebike no if it's an electric motorbike potentially yes as it's required to have 3rd party insurance

Glad you’re all ok

a hot and run is really scary experience

have you got any dash cam footage?

nnot sure whether mib only covers hit and run drivers or bikers as well, sorry

Thanks for your reply. In honesty, I'm not sure as it all happened so fast. The witness said it looked like an e bike. He was wearing a motorbike helmet though. Maybe the CCTV footage would show this?

Thank you, yes we are were and I'm assuming he was too considering the speed he sped off. I don't have dash camera unfortunately, annoyingly my husband has one in his car, I've not had this car very long so not got round to fitting it but will be in the future.

You can submit a claim. The MIB exists to deal with claims arising from accidents involving uninsured drivers, or where there is no third party to claim from. It's not a guaranteed payout tho.

Sorry, just re-read the OP. No you wont be able to claim. It has to be a vehicle that should be insured, and an ebike isn't required to have third party insurance, unless it was modified to be throttle only, or can exceed 15mph.

Very few genuine e-bikes would have someone wearing a motorbike helmet. I have an e-bike (middle aged mum) and use a normal bike helmet. Worth looking at it. Sorry this happened to you.

Thank you for your reply. I've spoken to the witness again and she doesn't remember the cyclist wearing a helmet at all! So now I'm thinking it was a hoody/ mask over his face. Hoping the CCTV footage will shed some light on it all but nothing more I can do now. I just hope they learn to be less wreckless on the roads. They really got off lightly!

Thank you for your advice. I've asked for a subject access request from the shop to see the footage myself in the hope of seeing the type of bike and if it could be modified. It does seem likely and there's such a dent in the car. I'll be getting the car fixed and passing it on to another owner who I'm sure will have better luck in it than me! Such a shame as it's a lovely car.
