Are you allowed to tape a phone call

Without informing the other party IF they have already said already they are taping the call?

Do you mean the other person said the call is being recorded and you want to record it too.

I don't think there's anything that stops you from doing so. However there would be restrictions what you could do with it, I think. So if you used it personally, eg to check what you'd said at a certain point I think that's fine.
However you couldn't use it as evidence to prove you said that.

I might be wrong though.

It's a dispute with Virgin media, they claim one thing and I another. They have a recording in which, they claim, I agreed to something but won't play it to me.

I don't actually believe they have it on tape, as I didn't say it, but the issue would be sorted much quicker if I also had a recording and that's what got me thinking.

I know you cant use a recording without informing the other party but wondered if it was different if they already said they're recording it.

There’s an option to record your phone call on iPhone and, at the start, Siri announces “this call will be recorded”. There’s no reason why you can’t use that when you speak to companies. They’re unlikely to object if they are also recording the call themselves.

Not sure why you would want to record the call without telling them though.

Put in a Subject Access Request and include all calls and transcripts of calls. If they have it, they’ll have to provide evidence of it. As it’s data relating to you, you have every right to request it. They have 30 days to comply.

Interesting, I'll have a look on my Samsung so hopefully they'll have something similar. Thanks.

They've got 14 days to get back to me re their recording so if they haven't admitted they're wrong by then, I'll do the SAR.
