Pensions death and divorce

Cheery subject. FIL has died, MIL got allocated 70% of pension in divorce. Does anyone know what the rules are around this - will she still receive it, where will the other 30% go? I’m seeing a solicitor tomorrow but any ideas welcome.

Is it a DB pension or a DC pension?

I think it's quite common that once a person has passed away, the amount that gets paid to a nominated survivor reduces, in my DH's case I would get 50%. So I suspect she'll receive less.

I have no experience of this but I'm pretty sure when I was asked who to allocate my pension to, I said 70% to DH, and the other 30% split between my children. Or maybe that was some kind of life insurance... I wasn't sure what the norm was so just stuck that down, now I'm thinking I might have to revisit it! That's probably what it is.

A quick phone call to the pension provider should give the answer. Please post the answer when you get it, it may help others in the same position, going forward.

Do phone the pension provider, but posting here won’t help others. It will be entirely dependent on the type of pension and the rules for the particular scheme. Far too many variables to make one situation useful for others.
