Can I apply for a council house with a mortgage?

Sorry not sure this is in the right place.

My partner and I own a house with a mortgage. We are separating. We have 2 young children.

Does anyone know if I can leave the home and apply for a council house? I have nowhere else to go. The house we own will be sold eventually

Thank you

No, but the money for rent, and UC money is money not earned. It is money given for free by the Gov.

This may blow your mind down but some people in council / housing association houses pay their own rent with money they have earned
Where does the Op say she gets UC?

Money for rent is not earned????? Where the heck has all those rent payments that come out of my wages (that I earn), each month gone to then? Maybe I should tell the government that they owe me 26 years worth of rent.

This may also blow your mind BUT people who get UC may also pay taxes and live in mortgaged houses !

Early 90s, I threw my narcissistic bully ex out. I was left with 3 children under 3. The mortgage was paid by benefits. Unfortunately there was a high interest loan of 3 grand secured against the house which I just couldn't pay. Narc ex never paid a penny in child support. I was issued with an eviction notice and I was offered and accepted a housing association property.
You do have to be homeless or impending homelessness before they will help you.
Advice should be sought as to what your next move shiuld be.
Good luck!!

You can go on the social housing list, but you will not be allocated a property as long as you are living in the house you're in now. You may also be accused of 'making yourself homeless' (I hate that saying!) and not be allocated one, and may have to find your own private let home.

In fact, I would start preparing now for the possibility of having to find a private let property. If you do, make sure you get one that's a bit small, (1 bedroom too little,) then you will be allocated a social housing property a bit quicker. If you rent one to suit, that has enough bedrooms, you may NEVER get social housing.

As a pp said though, with some councils you won't be allocated a property unless you are homeless (and in temp accommodation.)

p.s. I didn't think it would be long before someone came out with that ludicrous drivel 'council houses are free.' 😆 I can't believe some people still think this.. It's almost funny! 😂

She will just have to make do and live in the house until it is sold.

The Gov are not a free money tree.

People need to start taking responsibility for their actions.

And if he’s abusive?

Redshoeblueshoe · 03/11/2025 10:28

It really depends on where you live. Ring the housing dept and ask them. I know someone who did this and she got a council flat.

Shimmerandshine21 · 03/11/2025 10:40

From what you’ve said shared ownership might be worth considering

Burningbud1981 · 03/11/2025 10:48

@PrincessOfBelair Check your councils housing allocation policy. Some have the exclusion that if you currently own a property or have a mortgage you are not eligible for the housing register unless DV is involved.

Also if the equity you receive once the house is sold is enough to rent or buy on the open market again you may not be eligible. Also be careful leaving the property you may be found to be internationally homeless.

If the relationship has just broken down and there is no DV involved you should just live there untill it’s sold. Ex couples have to do this all the time
