Property deeds advice after inheritance

I will try and keep it uncomplicated

basically myself and my sister inherited my parents house and a number of funds and investments. Totalling a hefty sum of money.

as the probate cash has trickled in over the last two years I have transferred it over to my sister (her half of the cash and mine) and the plan was to get a mortgage to cover the rest of it.

however, although I’ve been keeping a note of all the money I’ve transferred I didn’t realise how much it was. And she is now only owed a small sum…

there is one more investment to pay out which will reduce the overall amount she’s owed even more. She’s happy to receive this lump sum but would then like the rest in monthly payments so she doesn’t blow the lot, I’m happy to do this rather than getting a mortgage… but how will this legally work?

I obviously don’t want to send anymore cash over now until there’s a legal document in place which takes her off the deeds officially and the house is mine.

i have a record of all moneys transferred in a spreadsheet and on my bank.

what kind of solicitor do we need to speak to?

You need to contact a conveyancing solicitor who will transfer the property into your name and put a restriction on the title register in favour of your sister. You can then set up a declaration of trust which can detail the money owed to your sister and how it should be paid and once paid she will have no beneficial interest in the property.
