Scammed on eBay - clearly deliberate - contact seller or just go straight to eBay?

I've just been scammed on eBay - albeit for a low amount (£13).

I've been helping an older friend who is not at all tech-savvy. She has a brick phone that's 2G only, and she was informed by O2 that she needs to move to a 4G phone by the end of the year, as 2G phones will no longer work with them after then.

She wanted another brick phone, but obviously a 4G one. I looked on eBay and found one for her - all seemed to check out - but it's now arrived and it's a 2G phone. The photos of the box in the listing clearly said 4G, but seeing the slightly different box that has arrived, the '4G' was clearly photoshopped in. It looked the same to me, but my eagle-eyed geeky DS looked and said that the font for the '4G' was very slightly different from the rest of the line that said 'Nokia 105'.

Moreover, I now see that the later updated version of the Nokia model - the one that IS 4G - looks quite different from the older iteration in the listing and, indeed, the one that has just arrived. I haven't opened the sealed box, but it's obviously deliberately not as described - presumably to shift old stock that will very soon be obsolete. There's no way this was an honest mistake.

Do I bother approaching the seller first? Do I have to do that under eBay rules - to see what lie the scammer comes up with? Obviously I would do that for an honest mistake, but when it's a clear scam? I just want my friend's money back under eBay's guarantee. We also paid a little over £3 for postage, which is fine for the correct item, but infuriating for one that's obviously fake/incorrect/soon useless. I'm guessing their 100% positive feedback was fake too.

Does anybody have any ideas or suggestions? Thanks in advance.

Just go straight to eBay for a refund.

I'm an eBay seller, you need to mark it as not as described and let eBay deal with the seller.

I would message them first, tell them they've sent the wrong item, with a screenshot with the 4g circled and a picture of your box without it. Tell them you need a full refund including postage. If the play up, go to eBay, but the chances are they won't. Well done for noticing it before opening.

Open a claim via eBay. I had to open one today when an item that was described as ‘like new’ arrived completely battered. Contacted eBay and they refunded me straight away and said I can keep the item.

Try eBay. Having said that, in similar circumstances I sent the seller a glitterbomb, recorded delivery.

Ive sold on Ebay for 20 years. Go straight to them because they will nab the money from the sellers account as soon as they get the return request.

I'll go straight to eBay, then - let them deal with the scammer rather than bothering to negotiate myself.

Does anybody know if they could retaliate? I presume they won't be enabled to leave feedback in these circumstances?

I sell on Ebay.
Raise a return request as " item not as described " I think you can add photos to the request. If you can't add the photos to the return request, send a separate message to the seller as well including photos.

Hopefully the seller will respond and agree to a return. You should then receive a pre-paid label from the seller. When you post it, get a receipt from the courier.

If the seller doesn't respond or they don't offer a refund, raise it with Ebay. They are normally very good and will sort quickly if you have uploaded evidence.
Any issues phone Ebay customer services who are very helpful.
A seller can't leave a review and mark it as negative.
Once sorted you can leave an honest review.
Hope you get this sorted.

Hi OP, as others have said let eBay deal with it.
I’d recommend Backmarket for buying the phone,they sell refurbished phones and they are all quality checked, working and come with a guarantee. I bought my sons first phone through them recently and was really impressed
