Jury duty and severe anxiety/panic

I'm wondering if anyone works in the courts or has any experience with jury duty?

My mum has always suffered from anxiety and panic disorder, but in recent years it has been severe, and she developed depression too. There was extensive consultant level input (outpatients). In the last few years it has been largely under control (with the help of carefully balanced medication), and by that I mean she is functional and isn't passing out frequently, crying constantly, falling into deep depression, or spending half the time on the loo. Things can and do unsettle her and all of these symptoms happen sometimes.

She's 73, and received a jury service letter a few weeks ago 😱 She sent it back asking to be excused on the basis of her health and gave a brief outline. They still haven't responded 2+ weeks later and she is getting worse and worse as it hangs over her. It will be awful if she is forced to do it, there is no way it will be anything other than a waste of time for the court and traumatic for her to turn up and try. I don't even know if I could get her in the building.

Does anyone have any advice here? Are they likely to excuse her on the basis of this? What if they don't, who can I speak to to try and explain the impact here? I've tried to reassure her that if she is told to go she will be fine, we will support her with the travelling (I'm not sure practically how though!), and she's likely to just sit and be bored for a while etc. She's actually very turned on and is often a very useful type, but her mental health is under as much control as is possible and it still isn't up to this.

So, I'm trying to get my head around this before she gets a response so I can be prepared - any advice would be very much appreciated.

A quick Google tells me that, over the age of 70, you can apply to be excused, giving reasons, which it would appear that your mum has.

Just phone them, explain her age and her depression and anxiety

71 and over you can ask to be excused - regardless of health conditions - there will be contact number on the letter, so I would just give them a ring to confirm that they have accepted her response and she is summarily excused. If there isn't a number on the paperwork (which would be strange) then just Google the court and call them.

Thanks both. I haven't actually laid eyes on this letter, it's a very touchy subject (!), but she has told me it says mental health conditions are not taken into account unless you've been hospitalised. I accept that might not ot be true and she is misinterpreting something somewhere. I'll try and get my hands on it to see the contact details and to reassure her. Getting this dealt with with a phone call would be a weight off of my mind let alone hers! 😆 I'll push her a bit to hand it over...

My mum got a GP letter to support her excusal. It's free, its one of the only times you don't pay for a gp to give you this type of letter

Your poor mum. I hope she can be reassured she won’t have to do it. Mentioning the IBS will excuse her if the MH doesn’t. She can’t sit on a jury if she has to constantly be running to the toilet.

She will be excused on an age basis, but must apply for that.

As a matter of interest, does anyone know if jury members can leave their seat if they feel unwell or need the loo etc.? That is one of my fears - feeling trapped and not able to get out without a drama in court! "All rise.....ten minute break for Ms. wiminny to freshen up" I think I'd die on the spot.

I don't suffer any anxiety or worry issues, well I obviously do now, since I've been thinking about what I said above!

I'm trying to find any actual guidance or advice about being excused on the basis of age - I have found that being 71+ is reason to ask to be excused in Scotland, but we are in England and I can't find anything specific to England. Gov.uk doesn't mention age. I might be looking with my eyes closed of course, in which case if anyone can point me in the right direction I'd be grateful.

I don't know, but now I'm worried about being called for this reason too 🤦‍♀️😆 "Please remove Ms MNJury from the court"...

Yes.

you can pass a note to the court usher who will pass it to the judge.

i did jury duty a while ago and this was covered in their induction session.

obviously they encourage you to go to the loo outside of the actual sessions in court.

DP was excused because his IBS would have meant that he would need to have ready access to a ‘convenience’ which would disrupt the court proceedings.

no biggie, he phoned the Court’s admin number , explained the circumstances and was advised to write in. He heard back really quite quickly.

I'm sure in the past people with mental health conditions haven't been allowed to serve on a jury. I think perhaps some of them thought they shouldn't be excluded and it changed.

I know someone who said they had anxiety and never heard anything back. Didn't send a doctor's note. I think as soon as you mention mental health issues and anxiety and how you panic making decisions and ruminate you'd be excused.

You are expected to serve if summoned, you can apply for an excusal from jury service if you are over 70 and believe you cannot perform the duties

Hi, I just thought I'd share an update. She has had an email to say she has been excused, doesn't need to attend, and no further action required. Phew!
