NHS internal move

Hi, I'm really confused. I've been successful in securing a band 3 to band 4 role within the NHS. I gave my notice of 4 weeks or a touch longer to make sure in good faith my line manager had enough notice, which runs to the 21st of April but I'm away from the 23rd of April until 11th of May. My new line manager set my start date as the 12th of May to avoid 1 working day pre holiday but my current like manager refuses to change the leaving date. It currently means I will have to leave the NHS and lose my 5 year service and not get paid for my holiday. I raised to local union rep but he said I can't do anything. Surely this can't be right?!

If you have accrued leave days that you haven't taken by your leaving date they will have to pay you for those but not sure why they should pay for all of your holiday time as you won't have accrued that much holiday. A gap in employment won't affect some nhs terms conditions like holiday entitlement. You gave 4 weeks notice so it would only be goodwill for them to extend your notice past your contractual notice but can't see why it would be in their favour to do so if your on leave anyway.

It sounds like you need to ask your new manager to let you start one day before your holiday.

No I gave notice to leave without a date and said I would give the last day once I know a strat date as the NHS track system is a nightmare I then had a start date and gave my leaving date to be told too late they've chosen it. This is an internal move within the same service I'm not actually leaving just changing roles!

Can you ask your new manager to bring your start date forward, and take annual leave to cover your holiday? (I have done this before).

I only have experience of one Trust but the processing of this sounds completely wrong to me. If it's an internal transfer then it should be done on the system (both Trac and ESR if you use that) as a move from one job to another. You don't make someone a leaver and a starter again!

I presume you went through the recruitment process so contact either that team or the HR team to query. To reiterate that you are not a leaver. You are transferring. I would hope they would pick this up automatically but you never know.

You won't lose your service. We recently had an internal move and they did their first day and went off for 2 weeks.

Your current manager just needs to transfer you on esr.

Previous thread might help. I had 4 weeks unpaid paternity leave in addition to the 2 weeks statutory and did not affect my continuous service

Thanks all yes done via Trac and ESR. They told me to give notice to current role then changed the start date. I'm hoping my new line manager will bring the start date forward otherwise they've told me my 2 weeks leave is unpaid and I lose my length of service!

That's right...you do give notice to your current role but that's not the same as giving notice to the Trust and leaving and starting again.

The only reason your time off would be unpaid would be if you dont have any leave leave left to take, which would be unusual at this point in the holiday year especially as your entitlement will still be across the year if you're moving internally. That's not the same as a break in service though.

Caveat that I'm not an expert but they sound like they don't know what they're talking about so push back.

Thanks that's exactly as I see it I'm not leaving I'm changing roles. Yes leave has all been approved and fine. My current line manager doesn't want to pay my leave so wants me to move roles prior to the holiday and my new line manager doesn't want to have me working 1 day then off for 2 weeks. The union have said to just accept that and leave for 2 weeks and not get paid which is just crazy in my eyes. I will be pushing hard to both Monday to sort it out

Part of my NHS role is dealing with changes to assignments - ie changes to bands, additional assignments, assignment closures , terminations etc , and this poster is right - this doesn’t sound right at all OP, you aren’t leaving , your current assignment shouldn’t be terminated it should be changed (HR2 form really simple!) there should be no gaps at all ?

Unless you are changing trusts ? But you need to make sure your start date with new trust is within 7 days of your leaving date - so if leave on Friday then you need to start new role BEFORE the next Friday .
