CMS trying to contact other parent

Hiya,

Just wondered if anyone knows how this works if the paying parent just avoids contact from CMS?

So I opened a claim, from what I understand the payments would only be backdated to when CMS contact the other parent, not to the date I opened the claim?

So CMS have his phone number, he doesn't answer.

They've sent a letter and apparently he's given me a false address.

However he does have another child and using his National Insurance number they have linked it to his other case.

They are still trying to "verify" his details.

If he's given a false address so avoids letters, and avoids phone calls... when would my payments actually be backdated to, if at all?

By linking it to his other case and it showing on his account- is that enough?

Many thanks

Ask CMS?

It's from the date that the application is formally made.

If it’s the same rules if he’s got another live case with cms it will be from the date of assessment.

I had similar but it was the cms . My ex answered the phone once and said it wasn’t convenient so didn’t ring them back ..

so they decided to proceed . He was on benefits so may have been easier . It was then taken straight from his benefits .

we had a situation years later .. The post office were stopping payments from 3rd parties so needed to change where his payments were going . I ended up having to phone up every month . He was ignoring phone calls and letters .. so the moved to put him on collect payments .. He then managed to move payments ..

so my advice the cms get fed up on dealing with people playing the game so keep on at them

Ask CMS?

Yea I was just asking here because when I phone them I end up on hold for hours or getting cut off, I work Monday-Friday so it's difficult to call and be on hold for hours to get through.

Last I spoke to them they said they had linked it to his other CMS case (was previously telling me they couldn't find him).

But I just thought it was from when I opened the claim until someone told me it wasn't and it's when they contact him about the claim.

Hahaha good one. An hour on hold at least and that's every time. Only to then be magically cut off, again every time.

Ah cross post

It's not though, it says online it's from when they contact the other parent. But they haven't been able to contact him.

From bitter experience, they eventually close your claim and write off the debt.

I mean I think they have his correct details now as they have linked it to his other case, but as I understand it he's ignoring phone calls and letters.

The address he gave me was wrong but I'd think from the other case they would have his correct address.

Would they really write it off Shock

Terrible isn't it.

Thats what they did to me when my ex ignored their letters for 3 years. Perhaps things are better now as it was a few years ago!

It's not though, it says online it's from when they contact the other parent. But they haven't been able to contact him.

It says online that it's from when the case was opened. This is when the resident parents makes the application. I appreciate that the wording on lots of the sources is not very helpful but this is my understanding. Googling it produces an AI response that says the same as an aggregate response .

I can see nothing that says it's from when the nrp is contacted. I mean that would make no sense at all and would only reward avoidant nrp but let's be honest the whole system is shit so it wouldn't have surprised me to find out it was true!
