I am writing to you further regarding the matter of undelivered goods. You informed me that you were going to respond within 72 hours from your correspondence on the 29th of January 2025. I am disappointed I have not heard from you.
I am therefore formally informing you of my intentions to take civil action against Just eat. I have attached with this email a letter before notice which I have also sent by post (see attached evidence)
If I do not hear from you within 14 days I intend to issue proceedings against you.

This letter explained what is wrong with the order I made and why I am entitled to a refund. I am once again requesting a full refund of the purchase price of £34.14 on the grounds that S29 (2) of the Consumer Rights Act 2015 states the goods remain at the trader's risk until they come into the physical possession of the consumer, or a person identified by the consumer, to take possession of the goods. I enclose a copy of the proof of purchase and relevant evidence. I would like a reply as soon as possible so that I know you have received this letter. If you don't agree to the refund, could you please then send me a detailed response saying why you don't agree. To avoid taking court action, I am willing to use Alternative Dispute Resolution to resolve this problem. If I do not receive a satisfactory response from you within 14 days of the date of this letter, I intend to issue proceedings against you in the county court without further notice. This may increase your liability for costs. I refer you to the Practice Direction on pre-action conduct under the Civil Procedure Rules, and in particular to paragraph 13-16 which sets out the sanctions the court may impose if you fail to comply with the Practice Direction. I look forward to your acknowledgement.

I've checked the order details for you, and can see that we refunded you £33.14 on 09/02/2025.
Just so you know, refunds can take between 5-7 working days to appear back in your account (depending on your bank's policy) and we're not able to influence this timeframe in any way.
If you have any further questions about your refund, it's best to contact your bank first, so you can check the refund status with them.
