Is this fraudulent?

Hi,

Mum has a credit card that we both use (live together) for all monthly expenses. It is then cleared in full from my account each month

I do most of the shopping etc and use the card either via contactless, or with the pin when required. Obviously this is with mum's full consent.

Does this constitute or does the fact that she permits this mean that it's ok?

Have you been refused credit? If you use hers because you cannot get your own then I would say yes as the lender doesn't want to lend to you so you are acting dishonestly.

I would recommend reading the terms of the card and lending policy as that should be explicit on this scenario. Usually they say something like it's for the intended recipient only.

She could add you as an additional card holder and then you would get a card in your name. The account would be in her name though (you would only be a named card holder)

If the card is your mums then technically she is breaching the T&C's by giving you her PIN.

As a previous poster says, the best way would be for her to add you as an additional card holder.

‘Full consent’ is completely irrelevant. If someone else’s name is on the card, it’s fraudulent for you to use it. Your mum is breaking the terms and conditions by letting you know the PIN. You need to get her to add you as an additional cardholder.

You shouldn't be using her card even with her permission. She can add you as an additional card holder so you can use the account legitimately

It’s not fraud from a legal point of view as you gain nothing from it and you have her permission. Be prepared to be treated as a criminal and arrested if you get caught though (eg if the shop asks for ID and the names don’t match). You wouldn’t be prosecuted though. It will be against the T&Cs of her credit card though, which could cause issues if you get found out. As a PP suggested, she can get a second card in your name.
