rouge landscaper revenge!?

hi some advice needed. landscaper constatly not turning up for a large project, I have paid a substantial amount upfront, due to the size of the job.. but now 12 weeks in, when we should be near completion he says the job is too big and he can't finish it. I now have a huge mud garden consisting of tonnes of soil. my question is. can I take this soil and dump it on his lawn? I am more than happy to pay for this to be done. but not sure if its legal.. I have paid him to remove it. but he hasnt done so and nothing else can be done until it is removed. I just want to inconvience and embarrass him before I take him to the small calims court to try and recover my money? all suggestions very greatfully recived..

I think technically that would be flytipping although I understand the temptation.

Not only can nothing be done till it’s removed, it will be a complete mess come the end of winter if it’s not already! Whether you dump it on his garden or not it needs to go pronto.
Have you any confirmation in writing at all or even voice mail confirming he won’t be finishing the job?
If not, and you dump it with him, he may claim he never said it wouldn’t be finished!
Can you contact him with a deadline?
‘Dear Shyster Gardener (don’t call him that obviously), it’s become clear that my landscape job will is unlikely to be finished by your company so I will be taking you to court for the money I’ve paid upfront unless you are on my property within 48 hours finishing the job. If you are not, I will give you another 48 hours to arrange collection of the tonnes of soil you have left on my property, or I will be returning it to you’.
I’ve no idea if that would be considered a crime but given he’s conned you, I’d say he’s unlikely to pursue it criminally. But do keep all correspondence.

How are you actually going to 'take' that amount of soil anywhere? Furthur cost incurred. Go straight to court and inform and pester said 'landscaper'

thank you, I threatend for it all to be dumped on his driveway and he had a fit.. (lives with his father -in-law) needless to say has now come up with a repayment plan and I "think" I have a new landscaper interested in finishing the job.. I will keep you posted on the payments but I am still going to the small claims court. he has done this before and i'm gathering evidence form other clients he has let down.
