Small claims court in foreign country a year after acident (travel insurance q)

18 months ago, DH was hit by a motorbike when he was crossing the road in Madrid. He had multiple broken bones and had surgery there (valid EHIC) and our travel insurance got him home safe and sound. Everything was fine - he recovered over the course of the following year, the insurance covered the very few associated costs, and the motorcyclist was not injured. DH was very shaken by the whole thing and very happy to put it behind him.

This summer we were in my home country for the whole summer visiting family, and we got home just before school started to find a packet of legal documents had come in the post in July. They're in Spanish and English, and it's basically a summons for a small claims court claim for about 5k EUR to cover the value of the motorbike, damaged helmet, glasses and legal fees (the latter being more than the rest!).

Money is v v tight, and this is very stressful. We're both teachers and back to work now. DH is particularly stressed about it, of course. I have just contacted our insurance on their portal for the original claim.

Does anyone know how this works? I really really don't want to have to try to find a lawyer in Madrid and go through all this - I want the insurance company to make it go away. I'd love to know what to expect.
