Hi I'm just looking for some advice or if anyone has experienced similar in regards to accident claims.
Recently in the past few months I was completely written off and involved in a RTA with an ambulance.
The ambulance has admitted full liability as they only had blue lights, no siren and moved into a bus lane and ran a red light whilst I was emerging out of my junction from a green.
Anyway months Down the line I'm still batteling whiplash and my work has suffered because of it. It also reinited an old injury and have been having extensive physio.

I have received settlement amount. And it seems. Incredibly low, way below any expectation, even lower than when I received a claim back in 2014 for something much minor than this. It's only offering me for whiplash.
And not even accounting for my child's trauma either.
It was a case where we were very lucky to have left the accient walking.

I'm not sure if I have much of a case or an argument. I feel like there was partially wreckless driving and that it's been massively under valued. Am I able to reject the claim and go else where or would I face charges?
Anyone have any experience in this?
Tia

Do you have a solicitor? If not, you need one.

Aquamarine1029 · 02/09/2024 19:55

Why would you think you'd face charges? For what?

BaronessEllarawrosaurus · 02/09/2024 19:56

who has been dealing with the settlement for you so far, what have they said about the amount

If the following is true, you very much have a case.

Op, do you have legal representation?

whatonearthishappenin · 02/09/2024 20:29

Compensation for whiplash-only injuries is now assessed with reference to a fixed tariff regime. For example, a 3 month injury now only achieves £240.00. If you do not have any injuries other than whiplash you will be stuck with the fixed tariff amount.

I got £800 for whiplash in 1995.

It lasted 3 months. I'm still not right quarter of a century later. I shouldn't have settled. I should have gotten legal advice.

You need to speak to a personal injury solicitor

JohnCravensNewsround · 02/09/2024 20:53

Whiplash injuries are now dealt with on a tariff which is much lower than what you would have been offered in 2014.
Have you had a medical report done?

You can Google whiplash tariff 2024.
