Is anyone here an investigative journalist or can anyone recommend one.

The story is pretty outing so I will keep it vague, it's about someone in prison who has no prior arrests he was sent in with an ipp and no release date as yet, during the trial the judge told the jury about another event that they must disregard but when the judge sentenced him he placed the ipp due to the reason that he asked the jury to disregard, he has been inside for 16 years when he has seen others sentenced for the same offence given 12 months -4 years.
I think he needs to tell his story and the treatment he has received as its shocking.

You could contact Private Eye.

Getting an IPP with no prior history suggests one hell of a serious first offence, plus ongoing risk to the community. What was the offence? What was the second matter he was not tried for?

Personally if I was helping someone in that situation my first thought would probably be the person's MP.
Second thought might be Channel 4 news.
And I would do both, plus anything else I could think of, rather than only pursue one avenue. This kind of situation usually only yields justice after years of campaigning sadly.
Questions: does the person have a solicitor? Social worker?
Might also be worth contacting the Howard League for Penal Reform for advice.
Good luck OP. It's a big thing to take on.

The offence while serious was not a violent one but was seen as one due to other surrounding events, the only thing i can say it that argued, she hit him it went on for a bit and the events that surround this and was to be disregarded was national news.

It's for his mother was she is dying. He doesn't mind being in prison as he has all his needs and he has been left with nothing except him mum.

All IPP prisoners now have a presumption of release at parole, or they will from 10th September when new legislation will be brought in by the government. They will also no longer have a licence past the first 2 years.

What is it that you want from an investigative journalist? This person should be freed very shortly. If there had been a realistic chance of this sentence being inappropriate they should have appealed their sentence in the last 16 years? The fact it still stands would indicate that any appeal was unsuccessful or that they didn't appear it when they had the chance. I'm not sure what an investigation could do in these circumstances.

I feel for this person. IPP is a barbaric sentence for some very minor crimes. I'm just nit sure what you are expecting as an outcome given they are very likely to be released imminently.

heldinadream · 17/08/2024 11:19

@GoogleWhacking I may be wrong, but I believe I heard that's not applying retrospectively? So existing IPP cases will not benefit? Heard an item more than once on news, but I could have misunderstood.

GoogleWhacking · 17/08/2024 11:23

There are no longer IPP sentences issued so there is no way to apply the legislation apart from retrospectively

That's certainly not my understanding of what's happening.

IPP prisoners are not included in SDS40, it's only Standard Deteminate Sentenced prisoners. So they will not be included in the recalculated releases from Sept.

The Victims and Prisoners Act 2024 has indeed received Royal Assent, but there is no date for implementation yet. I've seen nothing to suggest it's happening in September, let alone a specific date in September...?

He has no release date, next preliminary parole date is in 2 years but that's not for parole it's to see if he is ready for parole.
Thank you for all the information and I will contact everyone who has been suggested.
