Can council tax refuse to refund me into my bank account..

I have been a prick and been paying council tax linked to my old address . Plus council tax linked to my current address for over 2 years . So I want to get that refunded into my bank. But im being told council tax will just trafer it to my current tax account.

But I really need it paid into my bank. Because if it just gos into the right tax account it will mess me up money wise.

Have you actually asked if they can refund the money into your bank account or have you just automatically been told it will come off your current bill?

DevilsIvyy · 16/08/2024 12:11

Haven’t you looked at a bank statement for 2 years?! How did you not notice?

Portfun24 · 16/08/2024 12:12

If you have underpaid on the current tax year they can but my local authority will ask if you want a refund or transfer if up to date on current tax year.

At my council, no refunds can be issued to someone who has arrears, if I tried to refund it would be refused by audit, so you may find the only option is to have the overpayment transferred to you current council tax account, as all councils administer council tax using the same legislation

UsernameTaken76 · 16/08/2024 12:18

If there is a payment plan does that mean there are council tax arrears for your current property? If yes, then I think they will use the overpayment on your old address to help reduce or clear these & complete the payment plan sooner.

Yeah this. If you owe them anything, which you are classed as owing if you choose to pay Council Tax monthly rather than annually, it goes back to tax account

MikeRafone · 16/08/2024 12:23

If you don't have arrears then there isn't a legal reason why they can't refund you. If you do have tax payments outstanding then yes they can refuse

icebearforpresident · 16/08/2024 12:25

I’m not clear on how it being transferred to your current property would mess you up financially? You’ve been paying council tax on two properties for years without noticing so clearly you aren’t in financial dire straits, transferring it to your correct address will remove any balance for this year, therefore stopping your payments and leaving you with the extra cash, and probably still result in some form of refund.

Because I Need to make a claim for uc. I will be 5 weeks with very little money. So I wanted to use that refund to cover me for 5 weeks whilst I wait for payment to Come in.

If you are in debt then they will take the full amount and place not the rest of this years outstanding tax.

The council tax demand comes in April 24 for the entire year and the gov. allow you to pay it in 10 instalments - but if you get behind with those instalments technically they can demand the full amount.

Om that basis the council will take the amount you have overpaid and pay of the tax mean and leave you with the rest to pay.

But for the rest of the year, your council tax instalments will be lower as a lot more of this years tax demand will have been paid off plus you will not be paying the extra instalments either from your previous property.

You can ask U.C. for an advance on the money to help you get through the 5 weeks

also don't forget to claim council tax relief if you are entitled to as that is separate form U.C.
