Has anyone taken their employer/former employer to an employment tribunal? If so, how did you find it?

I’ve had a preliminary hearing, which was fine. The judge said we need a second preliminary hearing to finish ironing out some issues. The respondent has been resisting everything, which is to be expected, I suppose. I have to write a disability impact statement and to send it to them.

Thanks for sharing. Did you need to share your medical records with them? With the respondent, did they do anything unexpected? I just assume they will seek to blame the claimant in anyway they can, or did they not do “dirty” tricks like that? Hope you’re as okay as you can be, it must be stressful x

I will need to share my medical evidence eventually, but not yet. The respondent has told me that they no longer have a specific (And damning) piece of evidence that I have been seeking, which is odd because I know that it exists.

It’s tough going, but I’m not too bad, thank you!

How does sharing medical evidence work? Do they request it from the NHS, or do you request it and decide what you’re comfortable sharing with them? I suppose I’m worried about unrelated things I don’t want to be shared being sent if I have no control over the request. With regard to the damning evidence going “missing”, how will you approach this?

I’m just curious because I’m going through similar, thanks for responding !

Just an update, apparently the other side are “very keen” to settle. Around 4 months until the final hearing now!

Thank you. It has been tough so far, but my witness statement has already been written and I’ve got my evidence. I’m pretty much ready to go now!

Following your thread OP and interested to see how long it takes to bring to resolution. I have just submitted an ET1 on behalf of my son for disability discrimination leading to unfair dismissal.

Be prepared for them to lie, and obfuscate.
Make sure that you have sound legal points to refer to.
Talk to the judge about each point as if they don't know law. You need to explain which law/ regulation/ policy points that you are referring to, and how it relates to your case. Don't assume the the judge knows all this already (they probably do)as they are judging on your case.
Be honest.
