new school absence rules - do you get fined before they are 5?

I am struggling to find a clear answer to this. Previously the rule as far as I've been aware is that before 5 you won't get fined. But I'm confused how this works under the new rules? They seem to be written in a deliberately confusing way, unless I'm being a total idiot which, I admit, is a possibility!

As far as I understand it, the legal school age is the term after a child turns 5 and I don't think that's changed with the new rules. I believe that means they can't fine you until the term after the child turns 5. But someone else more knowledgeable might be along to correct that.

I took my son out of reception class for a few day when he was 4 to get a cheaper holiday - returned late after Easter.

I emailed the school to notify as I didn't think I needed permission. They sent me a form which was authorised within minutes. So. O fine. In my mind - they had to authorise as he is under 5.

You're correct, you can't be fined until the date your child reaches compulsory school age. The dates are the 31 December, 31 March or 31 August after the child turns 5

Thank you that's useful. Does it still count towards the two unauthorised absences you're allowed per three year?
