21 Section eviction

Can someone plz help with advise plz been issued with a section 21 notice of eviction today 24 June have to be out by the 24 August I'm going local counsil advise place in morning will they help me get another property be for the 8 weeks are done

Probably not before the 8 weeks they usually tell you to wait for the LL to take you to court and wait for the bailiffs to tun up before they will rehouse you. Thats the advice i was given by the council 2 years ago but managed to find a private rental myself before the section 21 was up.

Can you look for another private rental? You have 8 weeks and if the LL is selling it is unlikely he will sell in 8 weeks. If you found another rental but couldn't move in until say 10 weeks he might let you stay if you explained you were waiting for screening checks to come back. One thing to consider is if you do refuse to move until taken to court, you will have a court order against your name. You'd find it very hard to get another private rental with that against your name because it shows up on finance screening.

Section 21 notice isn't an eviction notice. The landlord has given notice that they would like their property back but you don't legally have to leave. If you can find somewhere to move to then you should do that, but if you are relying on the council to house you then you likely have to wait for the landlord to actually evict you which will take some months after the s21 notice has expired. Contact shelter and the council's homeless department for proper advice.

he might let you stay if you explained you were waiting for screening checks to come back the landlord wouldn't have to 'let' her stay, she has the legal right to stay. She should to inform the landlord of when she was planning to leave if it's past the expiry of the s21 notice but she doesn't have to ask permission.

The council won't help you immediately but they will eventually if all else fails.

The August date is just the date after which your landlord can apply for a court order to evict you. Once that application goes through and the court actually grants an eviction order, then the council will help you. If you leave before the court order is granted you will be "voluntarily homeless" and the council won't help you directly but will signpost you to where to look for accommodation.

However you should make every effort to find somewhere to move to of you possibly can. You will need a reference from your current landlord if you go into a new private rental and fircing them to go through with the full eviction process won't help with that. Also the emergency accommodation that the council put you in if you are properly evicted will really not be at all nice. It should only be a last resort if you have no other options.
