I've been scammed and I don't know what to do next :(

I purchased two milk maid dresses off tiktop shopify thing (from a company called Lannvie) They had an offer of buy one dress and get a discount on another so I bought two- 1 yellow, and one white and green. When I received an order confirmation the email said 2 red dresses! The purchase was through Monzo.

So I emailed them back and said no that is incorrect please amend. No reply.
The parcel arrived- the front label was all in Chinese. I opened the parcel and there were the 2 red dresses. I looked for a return slip inside, no slip. There was just an email address on the front of the parcel amongst the Chinese address. So I emailed that address and told them I would like a refund and did not get a reply.

Then I searched the company name and emailed them using the email on the site telling them I would like a refund please advise how. No reply.

All of this took place back in March.

Monzo gave me a temporary refund but are claiming it back now as the merchant denied my dispute since I did not return the item according to their policy?
But how do?
There was no slip, no address, no email response from them when I asked how to return the item

What do I do?
I still have the dresses- which I have not and will not wear. I simply wanted to return them from the get go and get my refund :(

£40

For £40 I’d write it off as an expense lesson that at least isn’t the end of the world and put both dresses into the nearest Oxfam.

Not worth taking it further for the sake of £40. As they’re from China I don’t see what you could do anyway.

It's the principle really. They should not be able to get away with it. Consumers have rights

Just sell one of the dresses?

They should indeed. At risk of sounding harsh, this is why UK retailers cost a bit more. Buying from the cheapest outlet which sounds like a Chinese shop is asking for trouble. I'm guessing Chinese as you mentioned TikTok which is Chinese owned, however I am not familiar with the site you mentioned.

Ultimately, if you want consumer rights protection, you have to buy from an outlet that operates within the jurisdiction that provides those rights I'm afraid.

Of course they shouldn’t, but broadly speaking companies are bound by the laws of the country in which they’re based. If you choose to buy directly from a shop based in China, it’s Chinese consumer rights that apply.

I thought we get a 14 day cooling off period anyway or is that an EU thing?

I think you need to put this one down to experience and be grateful it wasn’t more money . In future always check the reviews for a company on trustpilot or similar and don’t use if they’ve got no / bad reviews .

datcherygrateful · 13/06/2024 11:22

I did not know the firm was Chinese owned. I bought things off TT before with no issues whatsoever.

So should workers and employees. But you were happy to disregard those for your sweatshop items.

As above. Write it off and learn a lesson.

Mirandasbiggestfan · 13/06/2024 11:23

I agree for £40 I would write this one off, give the dresses to charity (or maybe sell on Vinted?) & I wouldn’t buy anything via Tik Tok again. I always avoid those very cheap Chinese outlets.

It's a many places thing, but not the place you bought from. The US, the UK, the EU, and many other countries. Just not China.

TT is Chinese owned, so it will automatically push you towards other Chinese owned sellers. Chalk it up to experience I'm afraid.

Asking because their refund policy states that and yet they breached it

Lesson learnt- dresses go to charity and I won't buy anything off TT.

It was hard to find those dresses on other outlets- but still.

Always google these TikTok shops before ordering. Most if not all of them are drop ship companies selling from china.

I think the lesson here is that Chinese companies do not operate within our known norms. OK, so you didn't know before. You do now, so need to be more wary in future.

China is not known for sticking to any sort of code. Business, moral or otherwise.

Just a thought that if you want to try to recoup some money, you could try selling the dresses on Vinted/eBay etc.

datcherygrateful · 13/06/2024 11:32

V few consumers can with their heart prove the providence of their purchases so get off your high horse. Fashion is an easy target- but we are all complicit in something. From food, energy, clothing- no one can safely say they're morally superior.

I was asking for some guidance on who to go to or report this company
