Any employment solicitors on here?

Hi,

My husband was offered his dream job, a start date was agreed and he is nearly at the end of his notice period. Two days ago the company called to withdraw their offer with no explanation. His current work have already replaced him so he is now unemployed. We are in the process of buying a house and baby 2 is on the way. To say we are devastated is an understatement. Do we have any grounds to sue them?

We have contacted a few employment lawyers but they all want huge retainers to even look at our case. I know we'll need to pay but so we even have a case to start with?

Help!

If he had started the role and they terminated him on day 1, he would be entitled to his notice payment and nothing more.

Given they’ve rescinded the offer entirely, has he at least asked for the minimum notice term in his contract to be paid?

Has he called ACAS?

Did he sign a contract? If so, he should be entitled to the notice period pay at least.

As others have said, if a contract has been created it would be an entitlement to notice period only but that would also be dependent on the way the offer was worded.

As others has said , it will only be the notice period in the contract you will be entitled to. Stat notice is zero for employment of less than a month.

Ask @mumsnet to transfer this to Legal matters. There are a couple of law practitioners on there who give good advice.

no more guarantee that someone on that board is a solicitor than someone picking this up in active threads.

But given that we've all said the same thing I'm willing to bet that others on here are also employment lawyers who know what they're talking about.

No explanation at all? They just refused ro discuss it?

Averagelife · 30/05/2024 11:48

Maybe his references?

Maybe his references?

That’s what I thought.

it is very unusual for this to happen, but when it does, if it’s something to do with the company they would normally say restructure, or budgets or something.

with timing, it led me to believe it was a reference issue also.
