Afraid of capability disciplinary for incompetence at work

  1. If i do get a written warning, verbal warning etc. I heard it only stays on hr file for 6, 12 months etc.
  2. Thus, after it expires, and I go find a job in a FCA regulated firm etc., where they need to look at disciplinaries like written warnings, will the firm still see my embarrassing capability failures
  3. e.g. I work in consulting but if I want to move over to a pension fund, something that is highly regulated, will the firm see my capability letter?
  4. If you can't answer this, who shall I contact? An employment lawyer?

How long have you worked there?

If under two years and there’s already a question over your capability, they’re much more likely to go straight to dismissal.

OP. I think you should consider resigning and finding a role that has fewer personal interactions. ie one where a few close people can get used to your communication style and will 'put up with it' because technically you are good (if you are).

I used to work in software development. There were some very 'quirky' people but they were very good technically and productive if managed appropriately.

under 2 years, i read the hr policy, they said a straight dismissal at my firm was unlikely unless it was gross misconduct
I'll likely be PIP'd first then dismissed

From the OP's other threads this isn't a gross misconduct issue. This is about her communication style being unsuited to the work, especially where clients are involved.

OP, get yourself a 'back office' role, supporting those who do the client facing activities.

A PIP, used properly is not about getting you dismissed but supporting you improve in your role.

It should be explained to you clearly what the issue with your work is and how they can support you to improve.

If you want to continue in this role, then a PIP should help you clarify the expectations and how to meet them.

From your other posts, I'm not sure that you do enjoy this role and so do you want to stay?

OP, kindly, this series of threads about your current problems at work seems not to be helping you and you may be better of speaking to someone that can provide more concrete assistance (a union rep was a good suggestion, an employment lawyer, someone in your HR department).

It seems you have a lot of issues with the law firm you work for, separate from any issues they may have with you, so perhaps you should give serious thought to the advice you've had across various threads about finding a more suitable role that plays to your strengths rather than being in opposition to them.

OP I really think you should seriously consider the above suggestion, as it seems very clear from your multiple posts here that almost every interaction in your current role is causing some kind of issue both for you and the firm. Working in a social, team based role doesn't seem to fit your communication style at all, would not something "back office" or remote with a much smaller group of people suit you better? It must be hard for you to work in this challenging environment, and clearly you are not being managed or having your needs understood well. It sounds like you have a very specific skill set that might work better in a less social environment.

You aren't taking on board any of the suggestions on the other 4 threads and are being very rude to people who are trying to help you.

OP, kindly you need to stop posting on mumsnet about your work issues and utilise some of the excellent suggestions re. a union and/or different role; the threads aren't helping you and are just frustrating posters and making them feel resentful now. There are also plenty of charities out there for neurodiverse individuals and you might find it worth looking into a coach/tutor if you wish to stay in your current role. Regardless in person, individualised help is going to be much more use to you than strangers online.
