DLA think they have lost DDs renewal forms.

Has anyone else had DLA lose their child's forms? I am so frustrated. I called DLA chasing my daughter's renewal as it ends 20th April and I only sent it in mid March. I sent it tracked and signed for. I know it can take a few weeks, and I knew and accepted that I may have to miss a couple of payments due to the fact I sent them within the last few weeks of our claim. But I'm on week 3 and the renewal letter said to call if I hear nothing after 2 weeks of sending the claim. So I called to check what date letters they're scanning at the moment and get a rough idea of timings.

I called, the person I spoke to was really unhelpful. He told me that our forms haven't been scanned, and that going by my postage date and the dates their scanning it should have been scanned around 1- 2 weeks ago and that the forms are likely lost in the post. He wouldn't listen when I said it's tracked, said he couldn't help further, wouldn't put me through to anyone else, told me he'll send me a new form and that I can only accept I've lost the forms and wait it out and complain on gov.uk if I'm not happy with the service of DLA.

I got frustrated and told him that they're not lost in the post. It was sent tracked and signed for and I have a receipt with all the details, including a signature, confirmation it arrived at the correct Wolverhampton office and a picture on the royal mail tracking page of our envelope on the post pile in the mail room. I said that if steps aren't taken to resolve this, I will not only be complaining on gov.uk, I will be seeking advice from the ICO and seeking legal advice because I'm concerned about the blasé attitude to the fact my daughter's personal and medical information has gone missing, and as arrival of the forms at the DWP office has been confirmed, this is their responsibility. Funnily enough he put me through to someone else pretty quickly after that.

I got through to a more helpful woman. She said that according to the system they're currently scanning claims from the 2nd of April, so ours should have been scanned two or three weeks ago but hasn't been for some reason. She's emailed the mail office/department with my tracking number and with all the details from the receipt, and has asked them to investigate as it should be somewhere on their system and our claim could have just ended up in the wrong pile.

Apparently she's going to call me tomorrow with an update.
She said she's quite confident it will get resolved and the forms will be found. However she's apparently sent a new form out just in case, as they take 10 working days to arrive, which also makes me a bit worried she's just faking confidence and the forms are indeed lost.

Apparently the situation has been explained in my case notes as well, but it depends on the case manager as to whether they'll treat it as a new claim or a renewal because some will disregard the notes and treat it as a new claim purely because it's late. Despite the fact a replacement form will only be late because they lost the forms! Apparently they also "can't" extend the claim to allow us to still get DLA if we need to wait for this to be sorted because that's not something they do, even if delays are due to errors on their part.

I'm really cross with the entire situation. It's completely unfair that there's no guarantee that they'll find the forms. And it's even more unfair that there's a chance our renewal will be treated as a new claim with a 23 week wait if I have to fill out replacement forms. I've done everything within the timeframes on my part so we shouldn't be penalised because of a mess up at their end.

It's also absolutely unfair that if we have to fill out new forms and they're treated as a new claim, then we will be denied our full back payment because of someone else's error. It also seems ridiculous that they don't extend claims when the reason for the delay is because they've lost the forms.

Has anyone else been through this? Did it get resolved? Is there anything else I can do? I'm just glad I'm impatient and chased after three weeks!

Not what they told me yesterday. My renewal was sent back about 6 weeks ago and my sons claim ended yesterday, it's not been done and they told me renewals have an 11 week backlog and I may hear something in June.

I think you may have misunderstood my post. I'm not talking about my claim not being done. I'm talking about it not being scanned into the system. Meaning the forms haven't been received and put into the "queue" to be done.

Both people I spoke to today have said letters from the 2nd April have been scanned into the system as "received". They are saying they think our renewal claim has been lost because they should have been scanned and put into the "queue" two weeks ago.

Like I said in my post, I'm aware that we would likely miss a couple of payments due to when I sent the forms. I'm not concerned about that. I'm concerned they've lost my child's personal and medical data, and don't seem concerned. I'm unhappy that the system is so unfair because we'll also potentially lose months worth of payments due to the fact that even though they've lost these forms, they're not obligated to treat replacement forms as a renewal meaning we may have to wait 23 weeks rather than 11, even though I've done everything correctly.

I hope your claim is done as soon as possible.

Hello, Im having the same issue on my end at the moment. Little ones renewal ends 14/04 I sent forms back on signed/Tracked and they received them on 22/3. Called multiple times and nothing is on the system. Spoke with 3 different advisors and been told different by each of them. Likewise I’m extremely worried all her medical information is missing. Just feel like I’m getting nowhere! I’ve been advised to call again this coming Friday so I’m keeping everything crossed. Is there any update on your end?

I'd contact the data protection officer (this should be available somewhere on their webaite) and register a complaint that your DD PII has gone missing in their care. That may help to focus their minds.

Sorry if it's not much help for the OP, but if it helps others.

This is the first time things have been lost. All letters, reports were scanned/photocopied rather than originals, dated, and those and the extra information sheets had DDs full name, date of birth and NI number, as per the instructions on the DWP form. The same as when I sent her claim 2.5 years ago. I also sent it tracked and signed for, so they've established that her forms must have gone missing between the post room in Wolverhampton and the offices in Blackpool that renewals are taken to after post is sorted.

The only thing I didn't do was photocopy the actual DLA forms after I filled them out, which is something I do so I can refer back to it if circumstances are the same at the point of renewal.

Lost forms are actually more common than you'd think. The DWP have been in trouble with the ICO a few times because of it.

I'm sorry you're going through the same. I threatened the ICO and got quite lucky with a caseworker. She rang me yesterday to let me know the forms aren't anywhere on the system in the Blackpool offices, and to tell me she's emailed the DWP postal office in Wolverhampton to ask them to look for the forms. She's also confirmed that any late forms will be treated as a renewal. She's said she's calling me this afternoon to let me know if Wolverhampton respond to her.

I'm contacting the ICO today for advice because I don't feel it's being taken seriously that my child's data clearly isn't secure if they don't know where it is.

I would call today and tell them you're going to report the data breach. I'm pretty sure that's the only reason they're being helpful. Also please check your messages x

Fortunately I have had no reason to have dealings with the DLA people, although have in the past been in contact with other government agencies, including the DWP.
During a particularly frustrating, unhelpful and unproductive issue with the DWP where we we getting nowhere, I contacted our MP who got her staff to investigate and they were extremely helpful.
I used to work in local government, and when we had a query from an MP we had to give it priority. Not doing so was not an option!
In your position OP, this is what I would do.
